21549 1 ORDINANCE NO. 21,549 2 3 AN ORDINANCE TO AUTHORIZE THE MAYOR TO ENTER INTO A 4 RENEWAL INTERLOCAL AGREEMENT TO RECOGNIZE AND TO 5 CONTINUE THE ROCK REGION METROPOLITAN TRANSIT 6 AUTHORITY (FORMALLY THE CENTRAL ARKANSAS TRANSIT 7 AUTHORITY); TO AMEND THE MEMBERSHIP OF THE TRANSIT 8 AUTHORITY'S BOARD OF DIRECTORS; AND FOR OTHER 9 PURPOSES. 10 11 WHEREAS,by approval of Little Rock, Ark., Resolution No. 7,567 (March 5, 1986)the Little Rock 12 Board of Directors confirmed the City's participation in the Central Arkansas Transit Authority("CATA") 13 and authorized the Mayor of Little Rock to enter into the Central Arkansas Transit Authority Agreement; 14 and, 15 WHEREAS,by passage of Little Rock,Ark., Ordinance No. 15,860 (May 17, 1990)and Little Rock, 16 Ark., Ordinance No. 15,907 (July 17, 1990), the Little Rock Board of Directors approved several 17 amendments to the Central Arkansas Transit Authority Agreement; and, 18 WHEREAS, the proposed Renewal Interlocal Agreement changes the name of the Transit Authority 19 to Rock Region Metropolitan Transit Authority and includes the following changes: 20 (1)Cities of Jacksonville and Cammack Village are no longer participants in the Agreement. 21 (2)The Transit Authority Board of Directors is increased to twelve(12)members,formerly eleven 22 (11),to be selected as follows: 23 (a)Five(5), formerly three(3), by the Board of Directors of Little Rock; 24 (b)Three(3),formerly two(2),by the Mayor of North Little Rock; 25 (c)Two(2)by the County Judge of Pulaski County; 26 (d)One(1)by the Mayor of Maumelle;and 27 (e)One(1)by the Mayor of Sherwood. 28 (3) Funding appropriations for the Rock Region Metropolitan Transit Authority will be 29 determined each year by an affirmative vote of at least nine(9),formerly ten(10)members of 30 the Transit Authority Board; and, 31 WHEREAS, the Little Rock Board of Directors wishes to recognize and continue the Rock Region 32 Metropolitan Transit Authority by approval of the Renewal Interlocal Agreement. 33 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 34 OF LITTLE ROCK,ARKANSAS: [Page 1 of 2] 1 Section 1. The Mayor is hereby authorized to enter into the Renewal Interlocal Agreement of the Rock 2 Region Metropolitan Transit Authority in substantially the same form as that attached as Exhibit A to this 3 ordinance. 4 Section 2. This ordinance will not become effective until the Renewal Interlocal Agreement has been 5 submitted to the Attorney General of the State of Arkansas for review and such review has occurred or the 6 Attorney General has determined that such review is unnecessary. 7 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 8 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 9 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 10 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 11 ordinance. 12 Section 4. Repealer.
