3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER AND CITY
4 OFFICIALS TO EXECUTE ANY NECESSARY DOCUMENTS TO ENTER
5 INTO A REAL ESTATE PURCHASE CONTRACT WITH ROLF
6 HARTSELL,MELINDA PARDAXAY, DAISY HARTSELL AND CARTER
7 HARTSELL,TO ACQUIRE APPROXIMATELY FIFTEEN(15)ACRES OF
8 LAND FOR THE PURCHASE PRICE OF TWO HUNDRED SEVENTY-
9 FIVE THOUSAND, EIGHT HUNDRED THIRTY-THREE DOLLARS
10 ($275,833.000), CASH OR CASH EQULIVENT, FOR THE USE AND
11 BENEFIT OF THE LITTLE ROCK PORT AUTHORITY; AND FOR
12 OTHER PURPOSES.

14 WHEREAS,pursuant to Ark. Code Ann. § 14-54-302 (West Supp. 2016), as to be amended by 1977
15 Ark. Act 470, permits a municipality to enter into contracts to purchase, or to purchase,real property to be
16 used for a governmental purpose; and,
17 WHEREAS, the use of property in the name of the City of Little Rock, Arkansas, for the use and
18 benefit of the Little Rock Port Authority fulfills such a governmental purpose; and,
19 WHEREAS,the City of Little Rock,through its 2011 Capital Sales Tax Initiative,set aside money for
20 the specific purpose of expanding the real estate holdings of the Little Rock Port Authority; and,
21 WHEREAS,the Little Rock Port Authority has been actively exploring opportunities for expansion,
22 including the development of a 2008 Master Real Estate Acquisition Plan; and,
23 WHEREAS,the Little Rock Port Authority staff has worked with the Greater Little Rock Chamber of
24 Commerce, and other interested parties,to explore viable options for real estate expansion and determined
25 that this particular parcel will meet the future needs of the Little Rock Port Authority for economic prospect
26 recruitment purposes, and.
27 WHEREAS, the Little Rock Port Authority staff has extended a tentative offer of Two Hundred
28 Seventy-Five Thousand, Eight Hundred Thirty-Three Dollars ($275,833.00), based upon a third party
29 appraisal, for the property located at 6200 Thibault Road, Little Rock, Pulaski County, Arkansas, Parcel
30 No. 248021000080, and the offer has been accepted by the owner; and,
31 NOW, THEREFORE, BE IT RESOLVED BY THE LITTLE ROCK CITY BOARD OF
32 DIRECTORS:
33 Section 1. The City of Little Rock Board of Directors authorizes the City Manager and any other
34 necessary City Officials to execute a contract to purchase approximately fifteen (15) acres of land located

1 at 6200 Thibault Road, Little Rock, Pulaski County, Arkansas, Parcel No. 24R021000080, and more
2 particularly as 21-1N-11W;PT S1/2 SE SE BG SW CRN660' E1320' S330' W660' S330' W660'to POB
3 C/O 32185 21 1N 11, for use by the Little Rock Port Authority for the purchase price of Two Hundred
4 Seventy-Five Thousand, Eight Hundred Thirty-Three Dollars ($275,833.00), contingent upon positive
5 findings of the Phase One Environmental Study, Phase One Archeological Study, determination of clear
6 title,and the confirmation of utility access to the site.
7 Section 2. Funding for this acquisition will come from the 2011 Sales Tax Issue that established funds
8 for land acquisition at the Port and allocated in the Little Rock Port Authority Funds.
9 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
10 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
11 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
12 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
13 resolution.
14 Section 4. Repealer. All resolutions, bylaws, and other matters inconsistent with this resolution are
15 hereby repealed to the extent of such inconsistency.
