JUSTIFICATION FOR PROPOSED VARIANCE

I am requesting a variance in order to build a workshop on the northwest
comer of my property. Due to the unusual shape of my lot and the space
needed it is necessary to build in the fifteen foot easement shown on the survey. The shop is to be twenty feet by twenty feet, with a brick facing
and siding on three sides. It will have electricity but not plumbing. The
pitch of the roofline will match my house and conform to neighborhood
association specifications. I have a letter from the neighborhood
association with said permission.
I have obtained all five letters from the required utilities along with a
letter from my neighborhood association.

Zoning Variance

The purpose of this letter is to provide a zoning variance application for the installation of a monument
sign to be located at the corner of 3rd Street and Broadway at the property located at 212 S. Broadway
Street. The reason this application is being made is because that the property is zoned Urban Use and
the proposed monument sign is not permitted. The proposed monument sign would be located in the
same place as the previous pole sign, however it would be cut down in size and repurposed as a part of
the internal structure of a new sign, as shown on the attached illustrations. We believe the proposed
application and installation of the monument is appropriate as it utilizes an existing structure and
replaces an unsightly pole within the boundaries of the property and does not place the monument sign
in an elevated position above the ground. Additionally, unlike many of the properties downtown, the
building is setback significantly from the road and, without adequate signage, adds an additional
hardship to the commercial functions of the business.
The proposed monument sign will attach to the existing metal pole and will consist of a base made from
rock or brick, a cabinet made out of aluminum and the faces panels made of acrylic with backlit LEDs.
The sign will be two sided, one facing each direction of Broadway. Each panel will have three individual
sign panels for company names. The sign frame will be 71.9" tall by 120" long in total, or approximately
sixty (60) square feet. The proposed monument sign will also include the building address along the
bottom portion.

evidenced by the multiple police reports and because we decided to take a stand against their criminal
behavior is why we are facing this issue of having our beloved deck taken away.
Mr. Monte Moore with the City of Little Rock told me there has never been a complaint filed
against the deck. With the pictures attached it clearly shows the deck was pre-existing before we
purchased the home, but there was never a complaint/problem with the deck until now it shows that
this attack is of malice intent NOT a true problem with the deck. The deck has been there with no
problems, no complaints at all. Being that our home has an unusual lot configuration it is side facing,
that locates the front door on the side and the back door is also at the side is another reason the deck
should be allowed to stay.
The deck should be approved because:
•We had no responsibility in the construction of the deck
•Pre-existing structure and not included in the property additions disclosure
•Deck has been in place for 2 years with no prior complaints from neighbors or problems with the
deck
•Would take away value from our home that was a major selling point and was included in the
selling price.
•Unusual lot configuration side facing home.
•Survey concludes deck is completely on our property and NOT on the neighbor's property, and is
feet away from the property line.
•Cost is expensive, would be out of excessive money, it would be a financial hardship for me on
top of being a college student.
•The deck has helped my family cope with this loss of my grandmother, my mother's mother by
creating a family friendly environment to help our family bond.
Best Solution:
•Even if the deck is torn down that will not solve anything because the issue is not about the deck
it is personal therefore, I think the best solution to decrease neighboring tension would be to
install a permitted fence to divide the properties.
Board of Adjustment I want you all to know that this experience has enlightened and educated
me on how to be a more informed homebuyer and what to look for in the future. I pray that you all
find it in your heart to see that we love our home and would be devastated if we had to tear down
part of it. I pray you can see the real matter of this situation is not about the deck and that simply
tearing it down will not solve anything. Please take this into consideration when making your
decision and put yourselves in our shoes as first time homebuyers. Please keep our dreams alive, the
dream I had when I first purchased this home for my mother!

OFFICERS RESPONDED TO THE LISTED LOCATION IN REFERENCE TO A DISTURBANCE. UPON ARRIVAL OFFICERS
MADE CONTACT WITH THE CALLER, EARNEST, WHO ADVISED SHE WAS IN A DISTURBANCE WITH HER NEIGHBOR,
LEVY, AND LEVYAS BOYFRIEND, WILSON. EARNEST ADVISED THAT OVER THE PAST YEAR SHES CONTINUOUSLY
HAD PROBLEMS WITH BOTH LEVY AND WILSON IN REFERENCE TO THE WHEREABOUTS OF THEIR DIVIDING
PROPERTY LINE. EARNEST ADVISED ON MULTIPLE OCCASIONS, WILSON HAS MADE VERBAL THREATS TOWARDS
HER MAKING HER FEEL UNSAFE. EARNEST ADVISED THAT SHE WOULD LIKE TO HAVE BOTH LEVY AND WILSON

A.Public Works Issues:

Public works standard detail PW-30.
2.No parking is allowed within the right-of-way.
B.Staff Analysis:
The R-2 zoned property located at 2000 N. Harrison Street is occupied by a one
story brick and frame single family residence. The property is located at the
northwest corner of N. Harrison Street and Kavanaugh Blvd. A one-car wide
driveway from N. Harrison Street is located at the northeast corner Qf the lot.
The applicant proposes to construct a one (1) story garage at the northwest corner
of the property. The garage will be 21 feet by 24 feet (504 square feet) in area. The
proposed structure will be located three (3) feet from the rear (west) property line
and three (3) feet from the north side property line. The garage will be located 19.7

Section 36- 156(a)(2)c. of the City's Zoning Ordinance allows a maximum rear yard
coverage of 30 percent for accessory structures in R -2 zoning. Therefore the
applicant is requesting a variance to allow the proposed garage structure with a rear
yard coverage of 43 percent.
Staff is supportive of the requested variance. Staff views the request as reasonable.
The lot has a relatively narrow width of 46 feet, which limits the amount of buildable
area. With the exception of the rear yard coverage requirement, the proposed
garage will conform with all other setback and separation requirements. The
proposed garage will not be out of character with other accessory structures in this
general area. Many other similar size accessory structures exist throughout the
Heights neighborhood. Staff believes the proposed garage with increased rear yard
coverage will have no adverse impact on the adjacent properties or the general area.
C. Staff Recommendation:
Staff recommends approval of the requested rear yard coverage variance, subject
to the compliance with the Public Works requirements as noted in paragraph A. of
the staff report.

Rear yard variance
Dear Commissioners:
I represent Mr. Peter Moschel of the above referenced address. Mr. Moschel is
completely renovating and adding an addition to the residence located at the above address.
We are requesting a variance for the 30% rear yard coverage rule for detached accessory
structures.
We propose to build a 21 -foot width by 24 -foot deep detached two -car garage
accessory building within the rear 25 -foot setback. Our plan locates both the west and the
north sides of the structure at the minimum allowable dimension of 3 feet. The footprint that
we propose would be 43% and would face the south of the property along Kavanaugh.
There are many other accessory garages in this area that exceed the 30% rule and
even exceed 43 %. We have elected to place the garage in this area to preserve the original
footprint and architectural of the 1920 structure and to preserve a larger "green space" north of
the existing home. This area is approximately 14 feet x 125 feet in length and would have
allowed for an expansion of the existing home by more than 675 square feet on the lower level.
We believe this to be far more congruent to the neighborhood and this provides more
balance of the home on the property.
