AN ORDINANCE VACATING A PUBLIC UTILITY EASEMENT IN
BLOCK 18 OF POPE'S ADDITION TO THE CITY OF LITTLE
ROCK, ARKANSAS.
WHEREAS, a petition was duly filed with the Board of
Directors of the City of Little Rock, Arkansas on the 5th
day of January, 1993, asking the Board of Directors to
vacate all that portion of the public utility easement
designated on the plat of Block 18, Pope's Addition to the
City of Little Rock, Arkansas, now appearing of record in
Plat Book H, Page 30, in the Office of the Recorder of
Pulaski County, Arkansas.
WHEREAS, after due notice as required by law, the Board
has, at the time and place mentioned in the notice, heard
all persons desiring to be heard on the question and has
ascertained that the easement, or portion thereof,
hereinbefore described, has heretofore been dedicated to the
public use as a utility easement herein described; has not
been actually used by the public generally for a period of
at least five (5) years subsequent to the filing of the
plat; that all the owners of the property abutting upon the
portion of the utility easement to be vacated have filed
with the Board their written consent to this action; and
that public interest and welfare will not be adversely
affected by the vacating of the utility easement.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas,
releases, vacates and abandons all its rights, together with
the rights of the public generally, in and to the public
- -- _ _- utility - easement - designated -as follows : - - - - - -- - - -- -- -- -- - -- __
The easement located within the 20 foot wide
north -south alley (from the south line of East 4th
street to the north line of East Capitol Avenue)
extending through the center of Block 18, Pope's
Addition to the City of Little Rock, Arkansas .
(NOTE: Resolution No. 21260, adopted December 1,
1958, vacated and closed said alley, but retained
easement.)
SECTION 2. A copy of this Ordinance, duly certified by
the City Clerk, shall be filed in the Office of the Recorder
of Pulaski County and recorded in the records of the County.
SECTION 3. This Ordinance shall take effect and be in
force from and after its passage and approval.
