AN ORDINANCE GRANTING TO TBE MISSOURI PACIFIC RAILHDAD
COMpAFF, ITS SUCCESSORS, LFSSEBa9 AND ASSIGNS, THE USE AND
OCCUPANCY OF CERTAIN SIDI WAL0 9 STREETS AND ALLEYS OF THE
CITY OF LITTLE ROCK, VACATING SAID SIDINA.L19. STREETS AND
AT.LEYS FOR SAID USES, FOR ERECTING A FBEIGRT STATIONt
CONSTRUCTING DRIVNW1.Y39 SIDE TRACKS, SWITCHES AND
APPROACHES IN CONNECTION THMNIFITH.
BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF LITTLE ROCK, ARMSAS :
SECTION 1, The Eiesouri Pacific Railroad Qompany, its
e000eseors, lessees and assigns, are hereby granted the right t0
use and occupy all of Sherman Street and Ferry "Street, and also

all of the alleys is Blocks Eighteen (18) , Nineteen (19) and
Twenty (20), of pope's Addition to the City of Little ilook,lying
i
between the south curb line of East Fourth Street and the north
curb line of East Fifth Street or Capitol Avenue, together with
the sidewalk space on the south side of East Fourth Street be-
tween the east curb line of Commerce Street and the most curb
line of Rector Avenue, and also the north eight (8) feet of the
sidewalk Apace on the north side of Bast Pifth Street or Capitol
Avenue from the east ourb line of Commerce Street to the west
curb line of Rector Avenue, for the purpose of locating, oonstraot
ing and maintaining a freight station and terminals for the re-
oeiving and delivering of freight, with the necessary driveways,
side traoks, spar traekag switches and approaches om Blocks
Eighteen (18), Ninsteea (19) and Twenty (20), of pope's Addition
to the City of Little Rook, Arkansas, and all f said greets,
alloys and sidewalk space are hereby vacat &iAfor the purpo es
herein named. And as fall compensation and in lieu of all other
rentals the grants* shall pay to the City of Little Rook for the
aforesaid use and ocoupation of said streets, alleys and sidewalks

be
made at
the time
when it shall begin

said freight station; the razing of any buildings now located on
Blooke 18,

and 20, of
Pope's
Addition to
the
City of Little
Book, shall
be
oonsidered
the
beginning of
said
construction.
Provided, if the Missouri Pacific Railroad Company is prevented
by causes beyond its oontrol from using and 0000pying the streets,
alleys and sidewalks so vacated, than the City of Little Hook will
repay to the Missouri Pacific dailroad Company all of said Twenty
Thousand (W,000.00) Dollars eo paid to the City, together with
legal interest thereon from the date it was paid.
SECTION 8. If in the oonstruotion of said improvements it
should become necessary in the judgment of the grantee to alter
or disturb city sewers, either atom or Sanitary, or any other
public works belonging to the City of Little Rook in said terri-
Cory, same shall be done according to plans and specifications to
be approved by the City Engineef of the City of Little Rook and
at the sole post and expense of the grantee herein, and the
tee will indemnify and hold harmless the City of Little Rook
all damage, oust and expense which may be caused to it by
eason of any snob alteration or disturbance or any violation of
rantse's obligation as aforesaid.
SECTION * This ordinance shall take effect and be in
e from and after its passage.
SECTION # 3. The Grantee will indemnify arch hold harAC
