19305I ORDINANCE NO. 19,305 3 AN ORDINANCE TO VACATE AND ABANDON A 70 -FOOT 4 PORTION OF THE 60 -FOOT WIDE PUBLIC RIGHT -OF -WAY OF 5 10TH STREET LOCATED BETWEEN SPRING AND BROADWAY 6 STREETS, IN THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR 7 OTHER PURPOSES. 8 9 WHEREAS, a request was made to abandon a portion of the public right -of -way 10 of 10th Street, immediately West of the alley right -of -way with Block 109, Original City 11 of Little Rock, pursuant to the City's general police power authority under Ark. Code 12 Ann. § 14 -54 -104; 13 WHEREAS, the Board has determined that the abandoning of this portion of the 14 public right -of -way will not have an adverse impact on the adjacent property owners 15 nor the local traffic, and therefore, the right -of -way abandoned by this ordinance is no 16 longer needed for corporate purposes except as otherwise noted below. 17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 18 OF THE CITY OF LITTLE ROCK, ARKANSAS: 19 Section 1. The Board of Directors hereby releases, vacates, and abandons the 20 portion of the said right of way of 10th Street, together with the right of public in 21 general, in the City of Little Rock, Pulaski County, Arkansas. 22 Section 2. The City specifically reserves the public utility easements within the 23 former right -of -way. 24 Section 3. A copy of this ordinance duly certified by the City Clerk, shall be filed 25 in the real estate records of the recorder of the Circuit Clerk in ex officio recorder of 26 Pulaski County, Arkansas. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged to be invalid or unconstitutional was not originally a part of the ordinance. Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
