21494 1 ORDINANCE NO. 21,494 2 3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF 4 COMPETITIVE BIDS DUE TO AN EXCEPTIONAL SITUATION; TO 5 AUTHORIZE THE CITY MANAGER TO ENTER INTO A SOLE-SOURCE 6 CONTRACT WITH IONWAVE TECHNOLOGIES, INC., IN THE 7 AMOUNT OF TWENTY-FOUR THOUSAND, ONE HUNDRED DOLLARS 8 ($24,100.00) PLUS APPLICABLE TAXES, FOR A ONE (1)-YEAR. 9 RENAWAL OF THE CITY'S ONLINE BIDDING SOFTWARE LICENSE; 10 AND FOR OTHER PURPOSES. 11 12 WHEREAS,the Cityof Little Rock utilizes IonWave Technologies software as its primaryapplication g pP 13 for supplier registration,online bidding and contract management for the Finance Department's Purchasing 14 Division; and, 15 WHEREAS, the current Software License Agreement with IonWave Technologies expired on 16 September 15,2017; and, 17 WHEREAS, the cost of Online Bidding Software Licensing and Support would otherwise require a 18 competitive bidding process; and, 19 WHEREAS, because staff wishes to complete its current transition to online bidding, and because 20 utilization of a different.Online Bidding Software Program would disrupt that transition, the Little Rock 21 Board of Directors finds that it is impractical and unfeasible to enter into a new bid process for Online 22 Bidding Software; 23 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 24 OF LITTLE ROCK,ARKANSAS: 25 Section 1. The Board of Directors finds that the requirement for competitive bidding for the Twenty- 26 Four Thousand, One Hundred Dollars($24,100.00)expenditure to complete the City's transition to Online 27 Bidding is impractical and unfeasible and,therefore,waives the requirement for competitive bidding. 28 Section 2. The City Manager is hereby authorized to enter into an agreement with IonWave 29 Technologies,Inc.,for Online Bidding Software Licensing and for support for supplier registration,online 30 bidding and contract management, in an amount not to exceed Twenty-Four Thousand, One Hundred 31 Dollars($24,100.00)plus applicable taxes. 32 Section 3. Funds for this expenditure are available in Account No. 102550-61350. [Page 1 of 2] 1 Section 4. Severability. In the event any portion of this ordinance is declared or adjudged to be invalid 2 or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this 3 ordinance, which shall remain in full force and effect as if the portion so declared or adjudged invalid or 4 unconstitutional were not originally a part of this ordinance. 5 Section 5. Repealer.
