9 WHEREAS, an application to rezone property located at 2904 South Arch Street from R-2, Single-
10 Family District,to PD-C,Planned Development- Commercial,filed by Ms. Linda Mickles,was denied in
11 a 1-9 vote by the Little Rock Planning Commission on August 31, 2017; and,
12 WHEREAS,the applicant timely filed an appeal of this decision to the Little Rock Board of Directors;
13 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
14 OF LITTLE ROCK,ARKANSAS:
15 Section 1. A public hearing shall be held on Tuesday, October 17, 2017, at 6:00 PM, or as soon
16 afterwards as the item is reached upon the call of the Agenda, in the Board Chambers on the second floor
17 of City Hall, 500 West Markham Street, Little Rock, Arkansas, on the question of whether to overturn the
18 denial by the Little Rock Planning Commission of a request by Ms. Linda Mickles to rezone property
19 located at 2904 Arch Street from R-2, Single-Family District, to PD-C, Planned Development -
20 Commercial.
21 Section 2. The City Clerk is directed to give notice of such hearing in the manner prescribed by law
22 by publication once a week for two (2) consecutive weeks in a newspaper published in Pulaski County,
23 Arkansas, and having a general circulation in the City of Little Rock.
24 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
25 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adju-
26 dication shall not affect the remaining portions of the resolution which shall remain in full force and effect
27 as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the reso-
28 lution.
29 Section 4. Repealer. All laws, ordinances,resolutions,or parts of the same,that are inconsistent with
30 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
