3 A RESOLUTION TO AUTHORIZE ACCEPTANCE OF A LAND
4 DONATION BY KUM & GO COMPANY OF APPROXIMATELY TWO (2)
5 ACRES OF LAND NEAR THE INTERSECTION OF CHENAL PARKWAY
6 AND WELLINGTON HILLS ROAD; AND FOR OTHER PURPOSES.

8 WHEREAS, the City has been offered a donation of approximately two (2) acres of land near the
9 intersection of Chenal Parkway and Wellington Hills Road which is to become a part of the extension of a
10 Bicycle and Trail Program that is consistent with the Parks&Recreation Master Parks Plan; and,
11 WHEREAS,after a Phase I Environmental Assessment no adverse impacts form the acceptance of the
12 property have been discovered;
13 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
14 OF LITTLE ROCK,ARKANSAS:
15 Section 1. The Mayor and City Clerk are authorized to execute any necessary agreements or other
16 documents approved as to legal form by the City Attorney to accept approximately two(2)acres of riparian
17 habitat along Rock Creek near the intersection of Chenal Parkway and Wellington Hills Road as illustrated
18 in Exhibit A to this resolution.
19 Section 2. The property to be dedicated is more completely described as follows: Part of the NW 1/4
20 Section 6,Township 1 North, Range 13, West in the City of Little Rock,Pulaski County,Arkansas,being
21 more particularly described as follows:
22 Commencing at the northeast corner of Lot 1, One Source Addition as filed for record in
23 Plat Book D, page 730,records of Pulaski County,Arkansas;thence South 59 degrees 54
24 minutes 17 seconds East along the southerly right-of-way line of Chenal Parkway, a
25 distance of 270.46 feet; thence South 18 degrees 13 minutes 32 seconds West along said
26 southerly right-of-way line,a distance of 5.92 feet;thence South 65 degrees 27 minutes 21
27 seconds East along said southerly right-of-way line,a distance of 163.16 feet;thence South
28 60 degrees 00 minutes 00 seconds East along said southerly right-of-way line, a distance
29 of 36.18 feet to the point of beginning;thence continuing South 60 degrees 00 minutes 00

11 of 64.38 feet to the point of beginning, containing 87,081 square-feet, or 1.999 acres of

13 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
14 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
15 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
16 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
17 resolution.
18 Section 4. Repealer. All laws,ordinances,resolutions, or parts of the same,that are inconsistent with
19 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
