3 AN ORDINANCE TO AMEND CHAPTER 36 OF THE CODE OF
4 ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS, TO
5 PROVIDE FOR THE DEFINITION OF MEDICAL MARIJUANA
6 DISPENSARY AND MEDICAL MARIJUANA CULTIVATION FACILITY,
7 AND THE PLACEMENT OF THOSE USES IN THE VARIOUS ZONING
8 DISTRICTS; AND FOR OTHER PURPOSES.

10 WHEREAS, the Medical Marijuana Amendment of 2016, Amendment 98 to the Arkansas State
11 Constitution, authorizes the cultivation and distribution of medical marijuana; and
12 WHEREAS,the Amendment permits cities,incorporated towns or counties to enact reasonable zoning
13 regulations applicable to Medical Marijuana Dispensaries and Cultivation Facilities, provided that those
14 zoning regulations are the same as those for a retail pharmacy; and
15 WHEREAS, it has been deemed appropriate to amend various provisions of Chapter 36 of the Code
16 of Ordinances of the City of Little Rock, Arkansas, to provide for the definition of Medical Marijuana
17 Dispensary and Medical Marijuana Cultivation Facility and to place those uses in the various Zoning
18 Districts in the same manner as retail pharmacies(drugstore or pharmacy as defined in Chapter 36); and
19 WHEREAS,at its June 22,2017,meeting,the Little Rock Planning Commission voted to recommend
20 approval of the proposed amendments.
21 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
22 OF LITTLE ROCK,ARKANSAS.
. 23 Section 1. That various provisions of Chapter 36 of the Code of Ordinances of the City of Little Rock,
24 Arkansas be amended as follow:
25 Subsection(a). That Chapter 36, Section 36-3.be amended to provide for the addition of two
"MedicalDispensary” and "Medical Marijuana(2) new use definitions Marijuana Cultivation
27 Facility"to be placed in the alphabetically appropriate locations in Section 36-3. said definitions to
28 read as follow:
29 Medical Marijuana Cultivation Facility means an entity which has been licensed by the
30 Medical Marijuana Commission and operated in compliance with all applicable state rules
31 that cultivates, prepares, manufactures, processes, packages, sells and delivers usable
32 marijuana to a dispensary.

1 Medical Marijuana Dispensary means an entity that has been licensed by the Medical
2 Marijuana Commission and operated in compliance with all applicable State rules that sells
3 medical marijuana. This term also includes cultivating dispensaries.
4 Subsection (b). That Chapter 36, Section 36-280. (c) (2) be amended to add and separately
5 list"Medical Marijuana Cultivation Facility"and"Medical Marijuana Dispensary"to the listing of
6 0-2, Office and Institutional District, accessory uses.
7 Subsection(c). That Chapter 36, Section 36-281.(b)(2)be amended to add and separately list
8 "Medical Marijuana Cultivation Facility"and"Medical Marijuana Dispensary"to the listing of 0-
9 3, General Office District,accessory uses.
10 Subsection (d). That Chapter 36, Section 36-299. (c) (1) be amended to add and separately
11 list"Medical Marijuana Cultivation Facility"and"Medical Marijuana Dispensary"to the listing of
12 C-1,Neighborhood Commercial District, permitted uses.
13 Subsection(e). That Chapter 36, Section 36-300.(c)(1)be amended to add and separately list
14 "Medical Marijuana Cultivation Facility"and"Medical Marijuana Dispensary"to the listing of C-
15 2, Shopping Center District,permitted uses.
16 Subsection(f). That Chapter 36, Section 36-301.(c)(1)be amended to add and separately list
17 "Medical Marijuana Cultivation Facility"and"Medical Marijuana Dispensary"to the listing of C-
18 3, General Commercial District,permitted uses.
19 Subsection(g). That Chapter 36,Section 36-302.(c)(2)be amended to add and separately list
20 "Medical Marijuana Cultivation Facility"and"Medical Marijuana Dispensary"to the listing of C-
21 4,Open Display Commercial District, conditional uses.
22 Subsection (h). That Chapter 36, Section 36-319. (c) (2) be amended to add and separately
23 list"Medical Marijuana Cultivation Facility"and"Medical Marijuana Dispensary"to the listing of
24 I-1, Industrial Park District,conditional uses.
25 Subsection(i). That Chapter 36, Section 36-320.(c)(1)be amended to add and separately list
26 "Drug Store or Pharmacy", "Medical Marijuana Cultivation Facility" and "Medical Marijuana
27 Dispensary"to the listing of I-2,Light Industrial District,permitted uses.
28 Section 2. Severability. In the event any title,section,paragraph,item,sentence,clause,phrase,or word
29 of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication
30 shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the
31 portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance.
32 Section 3. Repealer. All laws, ordinances,resolutions, or parts of the same that are inconsistent with
33 the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
