21448 1 ORDINANCE NO. 21,448 2 3 AN ORDINANCE TO AUTHORIZE THE CITY MANAGER TO DISPENSE 4 WITH THE REQUIREMENT OF COMPETITIVE BIDS FOR THE 5 PURCHASE OF THIRTY-ONE(31)LESS-THAN-LETHAL ELECTRONIC 6 CONTROL DEVICES FROM AXON, IN AN AMOUNT NOT TO EXCEED 7 SEVENTY-NINE THOUSAND, EIGHTY AND 76/100 DOLLARS 8 ($79,080.76), FOR THE LITTLE ROCK POLICE DEPARTMENT; TO 9 DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES. 10 11 WHEREAS, in 2011 the City Board of Directors determined that the use of Less-Than-Lethal 12 Electronic Control Devices was an appropriate tool for the Little Rock Police Department, and further 13 determined that it was impractical and unfeasible to bid for these devices in Little Rock, Ark., Ordinance 14 No.20,502(November 5,2011); and, 15 WHEREAS, it is necessary to add an additional thirty-one (31) such devices to the inventory of the 16 Little Rock Police Department from Axon,the name of the company initially known as Taser; 17 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 18 OF LITTLE ROCK,ARKANSAS: 19 Section 1. The Board of Directors finds that in light of the initial sole-source decision for Less-Than- 20 Lethal Electronic Control Devices purchased for the Little Rock Police Department by the company now 21 known as Axon it is impractical and unfeasible to bid this particular contract. 22 Section 2. The City Manager is authorized to enter into an agreement with Axon for the purchase of 23 thirty-one (31) Less-Than-Lethal Electronic Control Devices in an amount not to exceed Seventy-Nine 24 Thousand,Eighty and 76/100 Dollars($79,080.76). 25 Section 3. Funds for this purchase are available in Little Rock Police Department Training Division 26 Account No. 105220-60050. 27 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 28 word-of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 29 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 30 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 31 ordinance. 32 Section 5. Repealer. All resolutions, bylaws, and other matters inconsistent with this ordinance are 33 hereby repealed to the extent of such inconsistency. [Page 1 of 2] 1 Section 6. Emergency Clause.
