14612 1 RESOLUTION NO. 14,612 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER 4 INTO A CONTRACT WITH OAKLEY FERTILIZER, INC., IN AN 5 AMOUNT NOT TO EXCEED THREE HUNDRED THOUSAND DOLLARS 6 ($300,000.00),FOR THE PURCHASE OF ROCK SALT IN BULK FOR THE 7 PUBLIC WORKS DEPARTMENT OPERATIONS DIVISION; AND FOR 8 OTHER PURPOSES. 9. 10 WHERE AS, the Public Works Department Operations Division utilizes bulk De-Icing Rock Salt 11 during adverse winter weather to remove snow and ice from the roadways; and, 12 WHERE AS,the Public Works Department has obtained a bid quote from Oakley Fertilizer,Inc.,being 13 One Hundred Fifteen Dollars($115.00)per ton for Beet Juice Treated Rock Salt and One Hundred Dollars 14 ($100.00)per ton for Untreated Rock Salt as needed,and has also consulted with the Arkansas Highway& 15 Transportation Department (AHTD Bid Contract No. H-18-201J) with Oakley Fertilizer, Inc., being the 16 lowest responsible bidder meeting specifications; and, 17 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 18 OF LITTLE ROCK,ARKANSAS: 19 Section 1. The Board of Directors hereby authorizes the City Manager to enter into a contract with 20 Oakley Fertilizer, Inc., for the purchase of Rock Salt in bulk for the Public Works Department Operations 21 Division at a cost of One Hundred Fifteen Dollars ($115.00)per ton for Beet Juice Treated Rock Salt and 22 One Hundred Dollars ($100.00) per ton for Untreated Rock Salt as needed, in an amount not to exceed 23 Three Hundred Thousand Dollars ($300,000.00) per year, to be utilized during adverse winter weather to 24 remove snow and ice from the roadways. 25 Section 2. Funds for this purchase are available in the Streets &Drainage Maintenance Account No. 26 204003 -61020. 27 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 28 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 29 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 30 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 31 resolution. 32 Section 4. Repealer.
