21434 1 ORDINANCE NO. 21,434 2 3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF 4 COMPETITIVE BIDDING AS IMPRACTICAL AND UNFEASIBLE; TO 5 AWARD A CONTRACT TO RISK MANAGEMENT RESOURCES TO 6 PROVIDE THIRD-PARTY ADMINISTRATION SERVICES FOR THE 7 CITY'S SELF-FUNDED WORKERS' COMPENSATION PROGRAM FOR 8 A NINE (9)-MONTH PERIOD FROM JULY 1, 2017, TO MARCH 31, 2018; 9 TO DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES. 10 11 WHEREAS,the City operates a Self-Funded Workers' Compensation Program,and in order to ensure 12 proper processing of claims a Third-Party Administrator is utilized; and, 13 WHEREAS, the City has operated the last three (3) years with Risk Management Resources as the 14 company that provides such coverage;however,the question has arisen as to whether this contract is subject 15 to a new competitive selection process; and, 16 WHEREAS, the current coverage will end on June 30, 2017, and this ordinance is needed to provide 17 a coverage for the nine(9)-month period ending on March 31,2018; and, . 18 WHEREAS, it is necessary to submit this contract to competitive selection; however,the City cannot 19 obtain an extension to allow for such bidding without a nine (9)-month extension of the existing contract 20 with Risk Management Resources. 21 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 22 OF LITTLE ROCK,ARKANSAS: 23 Section 1. The Board of Directors has determined that it is necessary to submit the City's Third-Party 24 Administrator Agreement for the City's Self-Funded Workers' Compensation Program to competitive 25 selection; however, the City will need an extension of the existing contract with Risk Management 26 Resources to allow for such bidding;so it is impractical and unfeasible to bid this particular nine(9)-month 27 contract. 28 Section 2. The City Manager is hereby authorized to extend the existing contract with Risk 29 Management Resources for a nine(9)-month period from July 1,2017,to March 31,2018 to provide Third- 30 Party Administration Services for the City's Self-Funded Workers' Compensation Program at a rate of Six 31 Thousand Dollars ($6,000.00) per month so that the City may complete the competitive selection process 32 for a new contract for said services. [Page 1 of 2] 1 Section 3. Funding for this agreement is provided in Account No. 101003-52033. 2 Section 4. Severability. In the event any title, subtitle, section, subsection, subdivision, paragraph, 3 subparagraph,item,sentence,clause,phrase,or work of this ordinance is declared or adjudged to be invalid 4 or unconstitutional,such declaration or adjudication shall not affect the remaining portions of the ordinance 5 which shall remain in full force and effect as if the portion so declared or adjudged invalid or 6 unconstitutional was not originally a part of this ordinance. 7 Section 5. Repealer. All ordinances, resolutions, or parts of the same that are inconsistent with the 8 provisions of this ordinance are hereby repealed to the extent of such inconsistency. 9 Section 6. Emergency Clause. The City is required to comply with State Law as to the maintenance 10 of Workers' Compensation Coverage, and there is no present time to address issues about the renewal of 11 a contract for Third-Party Administration Services for the City's Self-Funded Workers' Compensation 12 Program and still meet this statutory mandate;further, only because this ordinance sets forth a specific 13 time frame for a new bidding process for these services, the Board of Directors is willing to move forward 14 at this time with this ordinance; an emergency is, therefore, declared to exist since such coverage is 15 essential to the public health, safety, and welfare, as the City has budgeted to meet its fiscal obligations in 16 2017; an emergency is declared to exist and this ordinance shall be in full force and effect from and after 17 the date of its passage. 18 PASSED: June 20,2017 19 ATTEST: APPROVED: 2 21maw6.0 1 � We.../erk— e 22 Allison Segars,Assista C Clerk Kathy Webb,Vice-Mayor 23 APPROVED AS TO LEGAL FORM: 24 25 .4 Orf 26 Thomas M.
