3 A RESOLUTION TO AUTHORIZE USE OF EMINENT DOMAIN ON
4 THE RECK ROAD CULVERT IMPROVEMENTS PROJECT; AND FOR
5 OTHER PURPOSES.

7 WHEREAS, attempts to acquire a temporary construction easement and a
8 permanent construction easement necessary for construction of the Reck Road Culvert
9 Improvements Project have been unsuccessful; and
10 WHEREAS, efforts will continue to acquire the easements without the use of
11 eminent domain.
12 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
13 THE CITY OF LITTLE ROCK, ARKANSAS:
14 Section 1. The City is authorized to use eminent domain to complete acquisition
15 of a temporary construction easement for this project.
16 Section 2. Funding for this property is available in account 315 - 220 -DP06.
17 Section 3. This resolution shall be in full force and effect from and after its
18 adoption.
