14512 1 RESOLUTION NO. 14,512 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER 4 INTO A CONTRACT WITH PUGH'S EARTHWORKS, IN AN AMOUNT 5 NOT TO EXCEED SEVENTY-EIGHT THOUSAND, FIVE HUNDRED 6 THIRTY-ONE AND 99/100 DOLLARS ($78,531.99), TO PROVIDE LAWN 7 MOWING AND GROUNDS MAINTENANCE SERVICES AT THE 8 OAKLAND & FRATERNAL HISTORIC CEMETERY PARK; AND FOR 9 OTHER PURPOSES. 10 11 WHEREAS, after the Oakland & Fraternal Historic Cemetery Park Board approved the bidding of 12 needed Lawn Mowing and Grounds Maintenance Services for the Oakland& Fraternal Historic Cemetery 13 Park,the City of Little Rock issued Invitation to Bid No. 17116 for said services; and, 14 WHEREAS,Pugh's Earthworks was the lowest responsive and responsible bidder for these services; 15 and, 16 WHEREAS, on February 23, 2017, at a special called meeting, the Oakland & Fraternal Historic 17 Cemetery Park Board approved Pugh's Earthworks to provide Lawn Mowing and Grounds Maintenance 18 Services for the Oakland&Fraternal Historic Cemetery Park; and, 19 WHEREAS,Pugh's Earthworks is ready and willing to provide these needed services. 20 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 21 OF LITTLE ROCK,ARKANSAS: 22 Section 1. A one (1)-year contract in an amount not to exceed Seventy-Eight Thousand, Five 23 Hundred Thirty-One and 99/100 Dollars 78 5 rtY ($ 31.99) is hereby awarded to Pugh's Earthworks, with the 24 possibility of up to two (2) additional one (1)-year terms, or a portion thereof, by mutual agreement and 25 on the same terms and conditions as the original contract, to provide Lawn Mowing and Grounds 26 Maintenance Services for the Oakland & Fraternal Historic Cemetery Park pursuant to Invitation to Bid 27 No. 17116. The City Manager is hereby authorized on behalf of the City of Little Rock Board of Directors 28 to enter into a contract in an amount not to exceed Seventy-Eight Thousand, Five Hundred Thirty-One 29 and 99/100 Dollars($78,531.99)for such services, in a form acceptable to the City Attorney. 30 Section 2. The funds for the contract are to come from the Oakland & Fraternal Historic Cemetery 31 Park Accounts. 32 Section 3. Severability. I n the event any title, section, paragraph, item, sentence, clause, phrase, or 33 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or [Page 1 of 2] 1 adjudication shall not affect the remaining portions of the resolution, which shall remain in full force and 2 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 3 resolution. 4 Section 4. Repealer.
