21367 1111111111111111111111111111111 III -2017011894 - PRESENTED:02-23-2017 10:19:59 AM RECORDED:02-23-2017 10:24:17 AM In Official Records of Larry Crane Circuit/County Clerk 1 ORDINANCE NO. 4U3.675 KI CO,AR FEE$20.00 2 3 AN ORDINANCE TO ESTABLISH AND LAY OFF LITTLE ROCK 4 MUNICIPAL PROPERTY OWNERS' MULTIPURPOSE IMPROVEMENT 5 DISTRICT NO.2017-324(KANIS RIDGE ESTATES PROJECT); AND FOR 6 OTHER PURPOSES. 7 8 WHEREAS, a petition to form Little Rock Municipal Property Owners' Multipurpose Improvement 9 District No. 2017-324 was filed with the City Clerk on January 5,2017, and contained certified signatures 10 of the property owners within the proposed District; and, 11 WHEREAS,the City Clerk has presented the petitions to the Mayor; and, 12 WHEREAS, in Little Rock, Ark., Resolution No. 14,502 (February 7, 2017) a public hearing was 13 properly set for February 21,2017,at 6:00 PM for the Little Rock Board of Directors to consider the petition 14 to form the district; and, 15 WHEREAS,the Little Rock Board of Directors has determined from an Abstractor's Certification that 16 the property owners who signed the petition constitute all the owners of the real property located in the 17 proposed District; and, 18 WHEREAS,the Arkansas Municipal Property Owners' Improvement District Law provides that if the 19 governing body determines that all the owners of the real property to be located in the District have 20 petitioned for the improvements it shall be the duty of the governing body, by ordinance, to lay off the 21 district as defined in the petition and to appoint the Commissioners named in the Commission; and, 22 WHEREAS, the petitions to create the District stated that it was the purpose of constructing 23 waterworks, sewers, recreational facilities and systems of gas pipelines, and for grading, paving, curbing, 24 and guttering street,and laying sidewalks,and to provide any facilities within the district that are related to 25 these uses; 26 NOW,THEREFORE,BE IT ORDINANED BY THE BOARD OF DIRECTORS OF THE CITY 27 OF LITTLE ROCK,ARKANSAS: 28 Section 1. The real property described in Section 2 of this ordinance is hereby established and laid off 29 as Little Rock Municipal Property Owner's Multipurpose Improvement District No. 2017-324 for the 30 purpose of constructing waterworks, sewers, recreational facilities and systems of gas pipelines, and for 31 grading,paving,curbing, and guttering street,and laying sidewalks,and to provide any facilities within the 32 District that are related to these uses. This section shall serve as an exhibit to identify the real property to be encompassed within 2 this district which is more formally described as follows: Tract 10, Sach's Suburban Tracts, being part of 3 Section 6,Township 1 North,Range 13 West,Pulaski County,Arkansas. 4 Section 3. The name of the Improvement District shall be Little Rock Municipal Property Owners' 5 Multipurpose Improvement District No. 2017-324. 6 Section 4.Severability. In the event any title,section,paragraph,item,sentence,clause,phrase or word 7 of this ordinance is declared or adjudged to be invalid or unconstitutional such declaration or adjudication 8 shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the 9 portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance. 10 Section 5.Repealer. All laws, ordinances, resolutions,and parts of the same that are inconsistent with 11 the provisions of this ordinance are hereby repealed to the extent of such inconsistency. 12 Section 6. Emergency Clause.
