2 A RESOLUTION TO AUTHORIZE THE USE OF EMINENT DOMAIN
3 ON THE COBB STREET AND BOYD STREET (PHASE II), TATUM
4 STREET (36TH TO 37TH), AND 37TH STREET ( TATUM TO BOYD) STREET
5 IMPROVEMENTS PROJECT; AND FOR OTHER PURPOSES.
6 WHEREAS, attempts to acquire some temporary construction easements and
7 right -of -way necessary for construction of the Cobb Street & Boyd Street (Phase II),
8 Tatum Street (3611, to 37th) and 37th Street (Tatum to Boyd) Street Improvements Project
9 have been unsuccessful; and
10 WHEREAS, efforts will continue to acquire necessary property without the use
11 of eminent domain.
12 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
13 THE CITY OF LITTLE ROCK, ARKANSAS:
14 Section 1. The City is authorized to use eminent domain to complete acquisition
15 of temporary construction easements and right -of -way for this project.
16 Section 2. Funding for this property is available in account 314 - 220 -SR12.
17 Section 3. This resolution shall be in full force and effect from and after its
18 adoption.
