2 A RESOLUTION TO AUTHORIZE USE OF EMINENT DOMAIN ON
3 THE AUXOR LANE DRAINAGE IMPROVEMENTS PROJECT; AND
4 FOR OTHER PURPOSES.
5 WHEREAS, attempts to acquire some right -of -way, temporary construction
6 easements, and drainage easements necessary for construction of the Auxor Lane
7 Drainage Improvements Project have been unsuccessful; and
8 WHEREAS, efforts will continue to acquire necessary property without the use
9 of eminent domain.
10 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
11 THE CITY OF LITTLE ROCK, ARKANSAS:
12 Section 1. The City is authorized to use eminent domain to complete acquisition
13 of right -of -way, temporary construction easements, and drainage easements for this
14 project.
15 Section 2. Funding for this property is available in account 315 - 220 -DP01.
16 Section 3. This resolution shall be in full force and effect from and after its
17 adoption.
