A RESOLUTION REQUESTING THE BOARD OF DIRECTORS TO ACCELERATE CITY EFFORTS TO AC)UIRE FLOODPROlJE PROPERTY AND TO DESIGNATE PUBLIC PURCHASE AS ONE I'&ETHOD OF IMPLEMENTING LITTLE ROCK'S FLOODPLAIN MANAGEMENT STRATEGY. WHEREAS,flooding is a serious and continuing problem for many areas of Little Rock,and WHEREAS,the Planning Commission is frequently called upon to approve subdivisions and to endorse zoning changes involving development in tloodprone areas,and WHEREAS,the public interest often favors acquiring such property in order to prevent inappropriate development which may be subject to flooding, and WHEREAS,in Resolution 6808,dated June 15,1982,the Board of'irectors stated its intent to appropriate General Fund Revenue sharing funds received by the City in 1983 and 1984 in an amount necessary to provide local matching j funds requi,ed for the Fourche Creek Basin Flood Contro'l Project,and WHEREAS,the City is currently pursuing an informal program of purchasing floodland on an as available basis,and substantial acreage has been acquired in this way. NOW,THEREFORE,BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF LITTLE ROCK,ARKANSAS. SECTION 1.The Board of Directors is hereby requested to formally designate public purchase of floodlands as a key component of the community's floodplain management strategy. SECTION 2.The Board of Directors is also urged to provide suff'icient funds to accelerate the ongoing acquisition program and to put this ef'f'ort in a firm financial footing. A RESOLUTION EXPRESSING THE INTENT OF THE PLANNING COMMISSION TO RETAIN DESIGNATED FLOODWAYS IN ZONING CLASSIFICATIONS COMPATIBLE WITH THE DRAINAGE FUNCTION OF SUCH AREAS. WHEREAS,flooding is a ser ious and continuing problem for mary ar eas of Little Rock,and WHEREAS,Boar d Resolution &f6786,passed Apr il 20,1982 states that "in light of chronic flooding problems exper ienced ty residents of the City in recent years,the Board hereby declares drainage to be one of its major priorities",and WHEREAS,the attractiveness of floodlands for urban development is enhanced by zoning such areas for commercial, industrial,or other uses having a high land value,and may generate development pressures which might not otherwise exist, and WHEREAS,the City of Little Bock is par ticipating in the Nat,ional Flood Insurance Program which identifies areas of special flood hazard throughout the City by means of Floodway Maps,and such program generally prohibits encroachmerts upon designated floodways,and WHEREAS,provision of adequate storm drainage throughout the City requires that floodways be kept free of structure and other impediments to proper drainage. NOW,THEREFORE,BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF LITTLE ROCK,ARKANSAS: SECTION 1.The Planning Commission hereby resolves not to recommend rezoning designated floodway areas for commercial, industrial,multi-family or other zoning classifications unless such rezoning is compatible with the drainage function of such This resolution shall not apply to non-floodway within the 100 year floodplain,such areas being stable for urban development provided necessary is accomplished. DE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTl E ROCK. ARRI'ISAS: SECTION 1.Section 37-28 of the Code of Ordinances of the City of Little Rock,Arkansas,is hereby amended by adding two subsections to be designated as (j)and (k)respectively,which subsections shall read as Ifollows: "(j)In order to protect the public interest,floodways in every subdivision shall be kept free of incompatible urban development.Floodways, as defined by the current Flood Hazard Boundary maps or as modified by IdetailedengineeringanalysisacceptedbytheCorpsofEngineersandthe City Fngineer,shall be either designated on the plat as drainage easements or,at the option of the landowner,dedicated to the public.Floodway easements shall be kept free of'tructural involvement,including fences, open storage of material and equipment,cantilever construction,vehicle parking,and other impediments to the free flow of floodwaters ~ (k)Vehicular access easements to allow public maintenance of drainage- ways shall be provided adjacent to floodways depicted on the City of Little Pock Flood Hazard Boundary Maps.Such easements shall be not less than twenty-five (25)feet wide,measured from the edge of the floodway on either s ide of the drainage channel.
