3 AN ORDINANCE WAIVING THE RIGHT-OF-WAY DEDICATION
4 PROVISIONS OF SECTION 1 OF THE MASTER STREET PLAN OF
5 THE CITY OF LITTLE ROCK, ARKANSAS, FOR THE PROPERTY
6 LOCATED AT 6724 WEST 32VD STREET, IN CONNECTION WITH A
7 CONDITIONAL USE PERMIT FOR A DAY CARE CENTER; AND FOR
8 OTHER PURPOSES (Z-9143).

10 WHEREAS, on July 14, 2016, the Little Rock Planning Commission approved a Conditional Use
11 Permit to allow a day care center to be operated within a portion of the existing church building located at
12 6724 West 32"d Street; and,
13 WHEREAS, that approval included the condition that the applicants dedicate right-of-way for West
14 32"d Street, Bryant Street and the radius at the intersection per Section 1 of the Master Street Plan of the
15 City of Little Rock, Arkansas; and,
16 WHEREAS, at its July 14, 2016, meeting, the Little Rock Planning Commission voted to not
17 recommend approval of the applicants' requested waiver of the requirement to dedicate right-of-way per
18 the Master Street Plan by a vote of 4 ayes, 6 nays and 1 absent; and,
19 WHEREAS, the Board of Directors has determined it is appropriate to not require the dedication of
20 right-of-way in connection with the approval of the Conditional Use Permit to allow the day care center to
21 be located within a portion of the existing church located at 6724 West 32"d Street.
22 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
23 OF LITTLE ROCK,ARKANSAS.
24 Section 1. The provisions of Section 1 of the Master Street Plan of the City of Little Rock, Arkansas,
25 requiring the dedication of right-of-way in connection with a Conditional Use Permit to allow a day care
26 center to be located within a portion of the existing church located at 6724 West 32"d Street are waived
27 and the dedication of right-of-way for West 32"d Street, Bryant Street and the radial dedication at the
28 intersection is not required.
29 Section 2. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph,
30 item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or
31 unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this ordinance,
32 as if such invalid or unconstitutional provision were not originally a part of this ordinance.
33 Section 3. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this
34 ordinance are hereby repealed to the extent of such inconsistency.
