3 A RESOLUTION TO AUTHORIZE USE OF EMINENT DOMAIN ON
4 THE GARDNER ROAD DRAINAGE IMPROVEMENTS PROJECT;
5 AND FOR OTHER PURPOSES.

7 WHEREAS, attempts to acquire some right -of -way and temporary construction
8 easements necessary for construction of the Gardner Road Drainage Improvements
9 Project have been unsuccessful; and
10 WHEREAS, efforts will continue to acquire necessary property without the use
11 of eminent domain.
12 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
13 THE CITY OF LITTLE ROCK, ARKANSAS:
14 Section 1. The City is authorized to use eminent domain to complete acquisition
15 of right -of -way for this project.
16 Section 2. Funding for this property is available in account 315 - 220 -DP03.
17 Section 3. This resolution shall be in full force and effect from and after its
18 adoption.
