4 WEST 29TH STREET, SOUTH FILLMORE STREET AND THE EAST-
5 WEST ALLEY RIGHT-OF-WAY (BLOCK 1, C.O. BRACK'S ADDITION),
6 ALL LOCATED WITHIN THE UNIVERSITY OF ARKANSAS AT
7 LITTLE ROCK CAMPUS AREA BETWEEN WEST 28TH STREET, FAIR
8 PARK BOULEVARD AND WEST 30TH STREET, IN THE CITY OF
9 LITTLE ROCK,ARKANSAS; AND FOR OTHER PURPOSES (G-23-463).

11 WHEREAS, the adjacent property owner, Board of Trustees of the University of Arkansas, requests
12 to abandon the following rights-of-way within the University of Arkansas at Little Rock(UALR)Campus
13 the pursuant to the City's general Police Power Authority under Ark. Code Ann. § 14-54-104: Santa Fe
14 Avenue (twenty (20)-foot width), between West 28th and West 29`h Streets (295 feet); West 29th Street
15 (forty (40)-foot width), west of Santa Fe Avenue and east of Fillmore Street (101 feet); South Fillmore
16 Street(twenty(20)-foot width), between West 29th and West 30th Street(363 feet); and the east-west alI " ,,,,;
17 right-of-way (twenty (20)-foot width), within Block 1, C.O. Brack's Addition (eighty-eight

19 WHEREAS, after abandonment, the area of abandonment will be incorporated into the ac jaeant`^_ :=R f
20 properties for the development of an Arts and Design Building and additional parking for the school"and- 4 `h '
21 WHEREAS all of the rights-of-way are currentlyundeveloped, and within the UALR Cam us`-a P•'� "
22 WHEREAS, none of the public utility companies object to the abandonment request and all areas of
23 abandonment will be retained as utility and drainage easements; and,
24 WHEREAS, all of the abutting properties are owned by the University of Arkansas Board of
25 Trustees, and the Fair Park, Curran-Conway, Oak Forest and University District Neighborhood
26 Associations were notified of the abandonment request; and,
27 WHEREAS, abandoning these rights-of-way will have no adverse impact on the public welfare and
28 safety and the Little Rock Fire Department has reviewed and approved the abandonment request;
29 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
30 OF LITTLE ROCK,ARKANSAS:
31 Section 1. The Board of Directors hereby releases, vacates, and abandons the following rights-of-
32 way: Santa Fe Avenue(twenty (20)-foot width), between West 28"'and West 29th Streets(295 feet); West
33 29th Street (forty (40)-foot width), west of Santa Fe Avenue and east of Fillmore Street (101 feet); South

1 Fillmore Street(twenty (20)-foot width), between West 29th and West 30th Street(363 feet); and the east-
2 west alley right-of-way (twenty (20)-foot width), within Block I, C.O. Brack's Addition (eighty-eight
3 (88)feet).
4 Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
5 records of the recorder of the Circuit Clerk in Ex-Officio Recorder of Pulaski County, Arkansas.
6 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
7 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
8 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
9 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
10 of the ordinance.
11 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are
12 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
