PRESENTED:07-19-2016 0932:13'AM RECORDED:07-19-2016 09:35:42 AM 5 r t..1.',4 �, ,:,---r,� == In Offioial Records of Larry Crane Circuit/County Clerk 77-�'" 61".'41_ .4,� f r—�= • ORDINANCE NO.21,266PULASKI CO,AR FEE$25.00 trtritA zt ii ',y y, 8ee lei ORDINANCE TO ANNEX PROPERTY TO CITY OF LITTLE ROCK 4 MUNICIPAL PROPERTY OWNERS' MULTIPURPOSE IMPROVEMENT 5 DISTRICT NO. 2012-313 (WILDWOOD RIDGE RECREATION AND 6 MAINTENANCE DISTRICT); AND FOR 7 • 8 WHEREAS,a Petition to annex property to City of Little Rock Municipal Property Owners'Multipurpose 9 Improvement District No. 2012-313 (Wildwood Ridge Recreation and Maintenance District)has been filed 10 with the Little Rock City Clerk;and 11 WHEREAS,the City Clerk has presented the petition to the Mayor;and 12 WHEREAS,the Mayor has set July 5, 2016, at 6:00 PM as the date and time for a hearing before the 13 Little Rock City Board of Directors for consideration of the petition;and 14 WHEREAS, the Little Rock City Board has determined from an abstractor's Certificate of Property 15 Ownership that those signing the petition constitute all the owners of the real property to be located in said 16 district;and 17 WHEREAS,Arkansas Code Annotated§ 14-88-503 provides that if the governing body determines that 18 all the owners of the real property to be located in the District have petitioned for annexation to an existing 19 District,it shall then be its duty by ordinance to annex the property as defined in the petition to the existing 20 District. . 21 NOW,THEREFORE,BE IT ORDAINED BY THE CITY BOARD OF THE CITY OF LITTLE 22 ROCK,ARKANSAS: 23 Section 1. That the real property described in Exhibit A attached hereto and made a part hereof is hereby 24 annexed to the City of Little Rock Municipal Property Owners'Multipurpose Improvement District No.2012- 25 313 (Wildwood Ridge Recreation and Maintenance District)for the purpose of constructing,either within or 26 without the boundaries of the District, if the property within the District will be benefited thereby,a sewage 27 collection system, water distribution system, telephone service system, cable television service system, 28 electrical distribution system, natural gas distribution system, a system of roads and streets, including 29 sidewalks, curbs and gutters, underground drainage system, a system of street lighting,retaining walls,and 30 landscaping,and all trenching,excavating,grading and all construction associated with the installation of the 31 above systems,together with facilities related to any of the foregoing within said District. 32 Section 2. The following three individuals are hereby ratified as commissioners of said improvement 33 district: Robert Graham Smith,Billy Chuck Collins and Scott M.Hurley. [Page 1 of 31 1 Section 3. Severability. In the event any portion of this ordinance is declared or adjudged to be invalid or 2 unconstitutional, such declaration or adjudication shall not affect the remaining portions of this ordinance, 3 which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional 4 were not originally a part of this ordinance. 5 Section 4. Repealer. All ordinances and resolutions, and parts thereof,which are in conflict with any 6 provision of this ordinance are hereby repealed to the extent of such conflict. 7 Section 5.Emergency.The City Board hereby determines that there is a need for additional infrastructure 8 within the City and hereby determines that the passage of this ordinance will facilitate construction of 9 additional infrastructure within the City.
