NEW BUSINESS: Z -8538-A 5218 Country Club Blvd. AUGUST 26, 2013 ITEM NO.: 1 File No.: Z -8538-A Owner: Chris and Julie Keller Applicant: Frank Riggins Address: 5218 Country Club Blvd. Description: Lot 7 and part of Lot 8, Block 11, Newton's Addition Zoned: R-2 Variance Requested: A variance is requested from the area provisions of Section 36-156 to allow construction of a pool with reduced front setback. Justification: The applicant's justification is presented in an attached letter. Present Use of Property: Single family residential Proposed Use of Property: Single family residential STAFF REPORT A. Public Works Issues: No Comments. B. Building Codes Comments: The required fire separation distance (building to property line) prescribed by the building code terminates at five (5) feet. Buildings are allowed to be closer than five (5) feet if they have properly constructed fire walls which provide the requisite one (1) hour fire resistance rating. When buildings are five (5) feet or more from the property line, the requirement no longer applies to the wall itself, only the projections such as eaves or overhangs. Openings such as doors and windows are limited when the exterior wall is three (3) feet from the property line, and are prohibited when the exterior wall is less than three (3) feet from the line. There is no restriction on openings when the exterior wall is more than three (3) feet from the property line. Contact the City of Little Rock Building Codes at 371-4832 for additional details. AUGUST 26, 2013 ITEM NO.: 1 (CON'T.) C. Staff Analysis: The R-2 zoned property at 5218 Country Club Blvd. is occupied by a one-story brick single family residence. A one -car wide driveway is located at the southwest corner of the lot. The driveway extends along the west side of the house to a garage in the rear yard area. This property owner also owns the two-story brick and rock single family residence immediately to the west, at the northeast corner of Country Club Blvd. and N. Harrison Street (5224 Country Club Blvd.). The second house has a two -car wide driveway from N. Harrison Street, with a garage at the northwest corner of the residence. The applicant proposes to remove the house located at 5218 Country Club Blvd. and construct a swimming pool (in -ground) and pool house, as noted on the attached site plan. The proposed pool will be located near the center of the lot, with a 48 foot setback from the front (south) property line and a 14.5 foot setback from the east side property line. It will be separated from the house by approximately 20 feet. The proposed pool house will be one-story in height, with setbacks of five (5) feet from the rear (north) property line and three (3) feet from the east side property line. It will be separated from the house (rear deck portion) by approximately ten (10) feet and the pool by approximately twelve (12) feet. There will be new landscaping, including an arbor and fence, located between the proposed pool and the front (south) property line. Both lots (Lots 7 and 8, Block 11, Newton's Addition) will be classified as a single zoning lot, with respect to building setbacks, coverage, etc. The applicant is requesting one (1) variance with the proposed project. Section 36-156 of the City's Zoning Ordinance requires a minimum front setback of 60 feet for accessory structures in residential zoning. An in -ground pool is considered an accessory structure. Therefore, the applicant is requesting a variance to allow construction of the in -ground pool with a front setback of 48 feet. The pool and pool house comply with all other ordinance setback, separation and coverage requirements. Staff is supportive of the requested front setback variance for the pool. Staff views the request as reasonable. Country Club Blvd. has a right-of-way width of 80 feet, which is much wider than the typical 50 foot residential street right-of-way. The lot's front property line is located 25 feet back from the edge of pavement, with 20 feet of grass -covered area. The existing residence immediately to the west (5224 Country Club Blvd.) has a front setback of approximately 20 feet, which is a typical front setback for residences along Country Club Blvd. in this immediate area. Therefore, the pool will be located much further back from the front property line than the homes along Country Club Blvd. Additionally, the pool being an in -ground structure will have very little visibility from the surrounding properties. Staff believes the proposed swimming pool with a reduced front setback will have no adverse impact on the adjacent properties or the general area. AUGUST 26, 2013 ITEM NO.: 1 (CON'T.) D. Staff Recommendation: Staff recommends approval of the requested front setback variance, subject to the following conditions: 1. Compliance with the Building Codes comments as noted in paragraph B. of the staff report. 2. The pool house cannot contain a kitchen facility or be used as a dwelling. 3. All fencing must comply with ordinance requirements. 4. The pool house coverage must not exceed 30 percent of the required rear yard area (rear 25 feet of the lots). BOARD OF ADJUSTMENT: (August 26, 2013) The applicant was present. There were no objectors present. Staff presented the application with a recommendation of approval. There was no further discussion. The item was placed on the Consent Agenda for approval as recommended by staff. The vote was 5 ayes, 0 nays, and 0 absent. The application was approved. Notices of this application will be sent to property owners within 200' of the subject property 10 days before the Board of Adjustment meeting on August 26, 2013.
