14369 1 RESOLUTION NO. 14,369 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO SUBMIT 4 ALL NECESSARY DOCUMENTS TO THE UNITED STATES 5 DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD) TO 6 REQUEST AN EXCEPTION OF A CONFLICT OF INTEREST FOR A 7 CITY EMPLOYEE WHO IS RELATED TO AN APPLICANT TO 8 UTILIZE HUD FUNDS FOR ASSISTANCE IN THE REHABILITATION 9 OF THE APPLICANT'S RESIDENCE; AND FOR OTHER PURPOSES. 10 11 WHEREAS,the City of Little Rock is a recipient of United States Housing and Urban Development 12 ("HUD")Funds annually to serve citizens and areas that meet the qualifying criterion outlined by Federal 13 regulations; and, 14 WHEREAS, Ms. Rose Conley applied for assistance to utilize HUD Funds through the City's 15 Housing and Neighborhood Programs Department Rehabilitation Program; and, 16 WHEREAS, Ms. Iglorida Conley is the daughter of Ms. Rosie Conley and is an employee of the 17 Housing and Neighborhood Programs Department for the City of Little Rock; and, 18 WHEREAS, Federal regulations state that in order to obtain an exception of the HUD conflict of 19 interest provisions, an opinion of the recipient's attorney that the interest for which the exception is 20 sought would not violate State or local law is required to be submitted to HUD; and, 21 WHEREAS, Federal regulations also state that there must be a public disclosure of the conflict of 22 interest; and, 23 WHEREAS, on March 23, 2016, the Little Rock City Attorney's Office issued City Attorney 24 Opinion No.2016-002; and, 25 WHEREAS, in this Opinion, the City Attorney concludes that as long as Iglorida Conley follows the 26 requirements set forth in the Opinion and in the City of Little Rock's Code of Ethics, Iglorida Conley's 27 potential conflict of interest under federal law does not violate any State or local law. City Attorney 28 Opinion No. 2016-002 is attached to this resolution as Exhibit A. 29 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF TILE CITY 30 OF LITTLE ROCK,ARKANSAS: 31 Section 1. The City Manager is hereby authorized to submit all necessary documents to the United 32 States Department of Housing and Urban Development to request an exception of a conflict of interest for [Page 1 of 2] 1 City Housing and Neighborhood Programs Department employee Ms. Iglorida Conley, who is related to 2 Ms. Rose Conley. Ms. Rose Conley is an applicant to utilize HUD Funds through the City's Housing and 3 Neighborhood Programs Department for assistance in the rehabilitation of the Ms. Rose Conley's 4 residence. 5 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 6 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 7 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 8 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 9 resolution. 10 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent 11 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency. 12 Section 4.
