21243 1 ORDINANCE NO. 21,243 2 3 AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF 4 ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS, 5 PROVIDING FOR A FIVE (5)-YEAR DEFERRAL OF MASTER STREET 6 PLAN CONSTRUCTION REQUIREMENTS AND FOR DEDICATION OF 7 RIGHT-OF-WAY AS REQUIRED BY THE MASTER STREET PLAN 8 FOR ARCH STREET AND WEST 28TH STREET; AND FOR OTHER 9 PURPOSES. 10 11 BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, 12 ARKANSAS: 13 SECTION 1. That Chapter 30 of the Code of Ordinances be amended to provide for a deferral for 14 five (5) years of certain requirements within the Master Street Plan on Arch Street and West 28th Street 15 for Deryan Coleman and Coleman and Son Automotive for the redevelopment of the property located at 16 2727 South Arch Street. 17 Subsection a. Chapter 30 Article VI requiring property owners to construct roadway 18 improvements and dedicate right-of-way to the requirements of the Master Street Plan be waived 19 for the proposed development to West 28th Street adjacent to the property at 2727 South Arch 20 Street. The specific deferral is for street widening, construction of sidewalks and right-of-way 21 dedication on West 28th Street. 22 Subsection b. Chapter 30 Article VI requiring property owners to construct roadway 23 improvements and dedicate right-of-way to the requirements of the Master Street Plan be waived 24 for the proposed development to Arch Street adjacent to the property at 2727 South Arch Street. 25 The specific request is for the deferral of the replacement of damaged or missing curb, gutter, 26 sidewalk and access ramps and right-of-way dedication on Arch Street. 27 Subsection c. If the property at 2727 South Arch Street is redeveloped or expands in the future, 28 the owner will be required to comply with the requirements of Chapter 30 Article VI to 29 reconstruct, widen and dedicate right-of-way to the requirements of the Master Street Plan on 30 Arch Street and West 28th Street adjacent to the property at 2727 South Arch Street. 31 SECTION 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, 32 or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 33 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and [Page 1 of 21 1 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 2 resolution. 3 SECTION 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent 4 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency. 5 SECTION 4.
