3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF
4 COMPETITIVE BIDDING AND AUTHORIZE THE CITY MANAGER TO
5 ENTER INTO A SOLE-SOURCE CONTRACT WITH CHAMPION TURF
6 FARMS, IN THE AMOUNT OF FORTY THOUSAND DOLLARS
7 ($40,000.00), FOR THE RESURFACING OF THE GREENS AT WAR
8 MEMORIAL GOLF COURSE; AND FOR OTHER PURPOSES.

10 WHEREAS, In 2009, the greens at Rebsamen Golf Course were converted to Champion Dwarf
11 Bermuda Grass and in 2013, the greens at Hindman Golf Course were converted to Champion Dwarf
12 Bermuda Grass, and golfers have been very complimentary of the greens at Rebsamen and Hindman
13 since they were converted; and,
14 WHEREAS, in order to maintain consistent quality and putting characteristics among all three (3)
15 Little Rock Parks and Recreation Golf Courses, staff recommends sprigging the greens at War Memorial
16 Golf Course with Champion Dwarf Bermuda Grass; and,
17 WHEREAS, since Champion Dwarf Bermuda Grass sprigs are a single-source item that can only be
18 purchased from Champion Turf Farms and unauthorized propagation is prohibited. Champion Turf
19 Farms is unlike any other company in that they plant greens all over the United States from just one (1)
20 set of nurseries, which allows them to institute controls and procedures that cannot be duplicated by a
21 corporate farm with dozens of nurseries, nor by a local grass farm which supplies sprigs to only a few
22 courses each year; and, most importantly, the entire process and procedures are overseen by the
23 owners/breeders themselves;
24 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
25 CITY OF LITTLE ROCK,ARKANSAS:
26 Section 1. The Board of Directors finds that competitive bidding should be dispensed with regarding
27 entering into a contract for the resurfacing of the greens at War Memorial Golf Course, and the contract
28 for such services should be awarded to Champion Dwarf Bermuda Grass as the sole-source provider for
29 these services.
30 Section 2. The City Manager is hereby authorized to dispense with competitive bidding and to enter
31 into a contract with Champion Turf Farms of Bay City, Texas, in the amount of Forty Thousand Dollars
32 ($40,000.00) to plant the greens at War Memorial Golf Course with Champion Dwarf Bermuda Grass
33 Sprigs,which includes guidance and technical assistance, sprigs and labor to sprig.

1 Section 3. Funds for this contract are available from account# 108459-S45A697.
2 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
3 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration J go or
4 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
5 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
6 ordinance.
7 Section 5. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with
8 any provision of this ordinance are hereby repealed to the extent of such conflict.
