5 THE CITY OF LITTLE ROCK, ARKANSAS, (G-23-461); AND FOR
6 OTHER PURPOSES.

8 WHEREAS, the applicant is requesting abandonment of two (2) platted alleys located adjacent to
9 Lots 7, 8, 9 and 10, Block 12 in the Ferndale Addition, with one (1) alley running east/west adjacent to
10 Lot 7, Block 12, Ferndale Addition to the City of Little Rock, for 150 feet and a north/south alley located
11 adjacent to Lots 7-10 & Lots 14-17, Block 12, of the Ferndale Addition to the City of Little Rock for 200
12 feet; and,
13 WHEREAS, none of the public utility companies object to the abandonment request but several of
14 the utilities request to retain the area of abandonment as a utility easement; and,
15 WHEREAS; according to an abstract company, there are no reversionary rights, and ownership of
16 the right-of-way will be split between the two(2)adjacent property owners; and, .
17 WHEREAS, abandoning these rights-of-way will have no adverse impact on the public welfare and
18 safety and the Little Rock Fire Department has reviewed and approved the abandonment request; and,
19 WHEREAS, all utility companies and Public Works have been contacted and all are in agreement to
20 the abandonment request;
21 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
22 OF LITTLE ROCK,ARKANSAS:
23 Section 1. The Board of Directors hereby releases, vacates, and abandons the platted alley located
24 adjacent to Lots 7, 8, 9 and 10; Block 12 in the Ferndale Addition.
25 Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
26 records of the recorder of the Circuit Clerk in Ex-Officio Recorder of Pulaski County, Arkansas.
27 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
28 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
29 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
30 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
31 of the ordinance.
32 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent . .\
33 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
