3 AN ORDINANCE TO AUTHORIZE THE PURCHASE OF NECESSARY
4 MF VISUAL COBOL FOR WINDOWS COMPILERS FROM INFOR
5 PUBLIC SECTOR; TO WAIVE COMPETITIVE BIDS AS IMPRACTICAL
6 AND UNFEASABLE; TO DECLARE AN EMERGENCY; AND FOR
7 OTHER PURPOSES.

9 WHEREAS, the City of Little Rock recently authorized an agreement with Infor Public Sector to
10 provide necessary upgrades and improvements of the Lawson System; and,
11 WHEREAS, it has now been determined that the City needs to purchase two (2)MF Visual COBOL
12 for Windows Compilers, and only Infor Public Sector can be authorized to provide these compilers to the
13 City under existing licensing agreements so that formal competitive bids are impractical and unfeasible;
14 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
15 OF LITTLE ROCK,ARKANSAS:
16 Section 1. The requirement of competitive bids for this agreement is found to be impractical and
17 unfeasible,therefore the requirement is waived.
18 Section 2. The City Manager is authorized to purchase two MF Visual COBOL for Windows
19 Compilers from Infor Public Sector in an amount not to exceed Twenty-Nine Thousand Four Hundred
20 Fifty-Two Dollars($29,452.00),plus any applicable taxes.
21 Section 3. Funds for this purchase are available in Account No. 326209-72450TS30A04.
22 Section 4. Severability. In the event any title, subtitle, section, subsection, subdivision, paragraph,
23 subparagraph,item,sentence,clause,phrase,or work of this ordinance is declared or adjudged to be invalid
24 or unconstitutional,such declaration or adjudication shall not affect the remaining portions of the ordinance
25 which shall remain in full force and effect as if the portion so declared or adjudged invalid or
26 unconstitutional was not originally a part of this ordinance.
27 Section 5. Repealer. All ordinances and resolutions, including but not limited to Little Rock, Ark.,
28 Resolution No. 14,283 (February 2,2016)are hereby repealed to the extent of such inconsistency.
29 Section 6. Emergency Clause. In order to provide all necessary computer services for City
30 Departments with the Lawson System that is being used it is necessary to have proper COBOL Compliers
31 in place; further, such a computer system is essential to the public health, safety, and welfare; and
32 emergency,therefore, is declared to exist and this ordinance shall be in full force and effect from and after
33 the date of its passage.
