3 ORDINANCE TO ABANDON THE UNDEVELOPED PORTION OF
4 THE FORTY-FOUR (44)-FOOT-WIDE ROSE STREET RIGHT-OF-WAY
5 LOCATED BETWEEN NORTH LOOKOUT ROAD AND KENYON
6 STREET (BETWEEN 4301 AND 4225 NORTH LOOKOUT ROAD) (G-23-

7 438-A), IN THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR
8 OTHER PURPOSES.

10 WHEREAS,a request has been made by the adjacent owners of the undeveloped portion of the forty-
11 four (44)-foot wide Rose Street right-of-way located between North Lookout Road and Kenyon Street
12 (between 4301 and 4225 North Lookout Road, being approximately 179.5 linear-feet), located in the City
13 of Little Rock, Arkansas, pursuant to the City's General Police Power Authority under Ark. Code Ann. §
14 14-54-104; and,
15 WHEREAS, all three (3) adjacent property owners have signed the petition to abandon and no other
16 property owners are required to be notified of the abandonment request; and,
17 WHEREAS,the Hillcrest Residents Association has been notified of the abandonment request; and,
18 WHEREAS, abandoning this right-of-way will have no adverse impact on the public welfare and
19 safety and the Little Rock Fire Department has reviewed and approved the abandonment request; and,
20 WHEREAS, several of the public utilities request to retain all or part of the area of abandonment as
21 utility easement; •
22 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
23 OF LITTLE ROCK,ARKANSAS:
24 Section 1. The Board of Directors hereby abandons the undeveloped portion of the forty-four (44)-
25 foot wide Rose Street right-of-way located between North Lookout Road and Kenyon Street (between
26 4301 and 4225 North Lookout Road.
27 Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
28 records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas.
29 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
30 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
31 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
32 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
33 of the ordinance.

1 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are
2 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
