3 AN ORDINANCE TO ABANDON AN ACCESS EASEMENT AND
4 UTILITY EASEMENT IN THE MAGNOLIA TERRACE ADDITION,
5 LOCATED AT 15104-15122 CANTRELL ROAD, TO THE CITY OF
6 LITTLE ROCK, PULASKI COUNTY, ARKANSAS; AND FOR OTHER
7 PURPOSES.

9 WHEREAS,a request has been made by the owner of the property at 15104-15122 Cantrell Road to
10 abandon an access easement and utility easement platted with the Magnolia Terrace Subdivision,on pursuant
,
11 to the City's General Police Power Authority under Ark. Code Ann. § 14-54-104; and,
• 12 WHEREAS, all property owners located within 200 feet of the site, along with the Tulley Cove
13 Neighborhood Association, the Westchester Neighborhood Association and the Pinnacle Valley •
14 Neighborhood Association were notified of the public hearing, and there were no registered objectors
15 present; and,
16 WHEREAS, abandoning this right-of-way will have no adverse impact on the public welfare and
17 safety;

18 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
19 OF LITTLE ROCK,ARKANSAS:
20 Section 1. The Board of Directors hereby releases, vacates, and abandons the access easement and
21 utility easement for property located at 15104-15122 Cantrell Road.
22 Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
23 records of the recorder of the Circuit Clerk in Ex-Officio Recorder of Pulaski County,Arkansas. •
24 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
25 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
26 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
27 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
28 of the ordinance.
29 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are
30 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsiste ®�'�� E"`c;�i,,,
