14238 1 RESOLUTION NO. 14,238 2 3 A RESOLUTION TO AUTHORIZE THE MAYOR OF THE CITY OF 4 LITTLE ROCK, ARKANSAS, TO ACCEPT FOR MUNICIPAL 5 PURPOSES, PERMANENT CONSTRUCTION EASEMENTS AND THE 6 CITY MANAGER TO ACQUIRE TEMPORARY CONSTRUCTION 7 EASEMENTS AS NEEDED TO COMPLETE THE CONSTRUCTION OF 8 THE SAFE ROUTES TO SCHOOLS HARRISON STREET SIDEWALK 9 PROJECT; AND FOR OTHER PURPOSES 10 11 WHEREAS, the Board of Directors has authorized a sidewalk improvement project on Harrison 12 Street from 14t Street to 22' Street by Resolution No. 13,753 funded by a Safe Routes to Schools Grant 13 in cooperation with the University District of the University of Arkansas Little Rock, and; 14 WHEREAS,the acquisition of easements is needed to accomplish the construction, maintenance and 15 continued access of adjacent properties. 16 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 17 OF LITTLE ROCK,ARKANSAS: 18 Section 1. The City Manager is authorized to pursue the acquisition of permanent construction 19 easements, right-of-way dedications and temporary construction easement as need to complete the 20 Harrison Street Sidewalk Project, 14«' Street to 22nd Street. 21 Section 2. The Mayor is authorized to accept permanent construction easements and right-of-way 22 dedications for municipal purposes and the City Manager is authorized to accept temporary easements 23 needed for construction. 24 Section 3. Funding for acquisition of easements and dedications is from the Safe Routes to Schools 25 Grant as authorized by Resolution No. 13,753 and the 3/8-Cent Capital Improvement Sales and 26 Compensating Use Tax for constructing Street and Drainage Improvement Projects. 27 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 28 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 29 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 30 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 31 resolution. 32 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent 33 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
