21114 1 ORDINANCE NO. 21,114 2 3 AN ORDINANCE TO DISPENSE WITH COMPETITIVE BIDS DUE TO 4 AN EXCEPTIONAL SITUATION; TO AWARD AN AGREEMENT WITH 5 OPTIV SECURITY, INC., FOR SECURITY AWARENESS TRAINING 6 FOR CITY EMPLOYEES, IN THE AMOUNT OF THIRTY-TWO 7 THOUSAND,FIVE HUNDRED DOLLARS($32,500.00); TO DECLARE AN 8 EMERGENCY; AND FOR OTHER PURPOSES. 9 10 WHEREAS, Security Awareness Training is a crucial component of annual PCI Data Security 11 Standard compliance and the security audits for the City's Finance Department and Police Department and 12 is required of government entities that participate in programs like the City of Little Rock does; and, 13 WHEREAS, such training has to be not only complete, but also accessible by a variety of individuals 14 who work for the City and are involved with certain financial transactions; and, 15 WHEREAS, after careful review of available potential products the Information Technology 16 Department was only able to find a limited number of companies that could provide the necessary material 17 in a format that best works with the City's Information Technology System; and, 18 WHEREAS,after this research it was determined that only Optiv Security, Inc., provides the necessary 19 and flexible system needed for various City employees and Departments; and, 20 WHEREAS, comprehensive security awareness training that addresses the City's specific needs is 21 critical to the protection of the City's network and data; and, 22 WHEREAS, it would be impracticable and infeasible to submit to competitive bidding a product that 23 only one company can provide, and thus would be contrary to the public interest to hire any data security 24 company other than Optiv Security, Inc., to provide the training content needed for the City's network and 25 database; 26 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE 27 CITY OF LITTLE ROCK,ARKANSAS: 28 Section 1. The Board of Directors dispenses with the requirement of competitive bids or selections for 29 security awareness training programs for City employees. 30 Section 2. The City Manager is authorized to enter into an agreement with Optiv Security, Inc., for 31 Online Security Awareness Training for all City employees who have access to the City's network or handle 32 payment card information, in the amount of Thirty-Two Thousand,Five Hundred Dollars($32,500.00)plus 33 applicable taxes. IPage 1 of 21 1 Section 3. Funds for this service are available in the Little Rock Information Technology Department's 2 Annual Operating Budget. 3 Section 4. Severability. In the event any portion of this ordinance is declared or adjudged to be invalid 4 or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this 5 ordinance, which shall remain in full force and effect as if the portion so declared or adjudged invalid or 6 unconstitutional were not originally a part of this ordinance. 7 Section 5. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with any 8 provision of this ordinance are hereby repealed to the extent of such conflict. 9 Section 6. Emergency Clause.
