3 A RESOLUTION TO AUTHORIZE USE OF EMINENT DOMAIN TO
4 ACQUIRE THE LUDWIG STREET (42ND STREET TO ASHER
5 AVENUE) STREET IMPROVEMENTS PROJECT; AND FOR OTHER
6 PURPOSES.

8 WHEREAS, attempts to acquire temporary construction easements necessary for
9 construction of the Ludwig Street (42nd Street to Asher Avenue) Street Improvements
10 Project have been unsuccessful; and
11 WHEREAS, efforts will continue to acquire necessary property without the use of
12 eminent domain.
13 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
14 THE CITY OF LITTLE ROCK, ARKANSAS:
15 Section 1. The City is authorized to use eminent domain to complete acquisition
16 of temporary construction easements for this project.
17 Section 2. Funding for this property is available in account 314 - 220 -SR17.
18 Section 3. This resolution shall be in full force and effect from and after its
19 adoption.
