14184 1 RESOLUTION NO. 14,184 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER 4 INTO A CONTRACT WITH DAYCO CONSTRUCTION, INC., IN AN 5 AMOUNT NOT TO EXCEED NINETY THOUSAND, TWO HUNDRED 6 FORTY DOLLARS ($90,240.00), FOR THE CONSTRUCTION OF 7 REQUIRED UPGRADES FOR THE ELEPHANT EXHIBIT AT THE 8 LITTLE ROCK ZOO; AND FOR OTHER PURPOSES. 9 10 WHEREAS,the Association of Zoos and Aquariums(AZA)has required certain upgrades to the Little 11 Rock Zoo's Elephant Exhibit for purposes of zoo accreditation; and, 12 WHEREAS,the City of Little Rock requested bids for construction of the required improvements at 13 the Elephant Exhibit,including the extension of bollards,installation of a new gate,relocation of an existing 14 gate and the addition of shade structures; and, 15 WHEREAS, Dayco Construction, Inc., submitted the low bid for the requested construction in the 16 amount of Seventy-Five Thousand,Two Hundred Dollars($75,200.00). 17 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 18 OF LITTLE ROCK,ARKANSAS: 19 Section 1. The City Manager is hereby authorized to execute an agreement with Dayco Construction, 20 Inc., for AZA-required upgrades to the Little Rock Zoo's Elephant Exhibit in an amount not to exceed 21 Ninety Thousand,Two Hundred Forty Dollars($90,240.00),which is the base bid amount of Seventy-Five 22 Thousand,Two Hundred Dollars($75,200.00)plus 20%for contingencies. 23 Section 2. Funding for this project will be paid from the Zoo's Deferred Maintenance Account,Special 24 Project 326659-TS65A66. 25 Section 3. Severability. In the event any title, section paragraph, item, sentence, clause, phrase, or 26 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 27 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 28 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 29 resolution. 30 Section 4. Repealer. All laws,ordinances,resolutions, or parts of the same,that are inconsistent with 31 the provisions of this resolution, are hereby repealed to the extent of such inconsistency. 32 Section 5.
