N62.521°,084 2 3 AN ORDINANCE TO REPEAL ORDINANCE NO. 20,696 (FEBRUARY 19, 4 2013) AND REVOKE A PLANNED ZONING DISTRICT TITLED 5 INTERSTATE 430 SHOPPERS MALL LONG-FORM PCD (Z-3371-TT), 6 LOCATED AT 11900 COLONEL GLENN ROAD, LITTLE ROCK, 7 ARKANSAS, AND AN ORDINANCE RECLASSIFYING PROPERTY 8 LOCATED AT 11900 COLONEL GLENN ROAD IN THE CITY OF 9 LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING 10 MAP OF THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER O„il,1,1t 1,, ,,,.r 11 PURPOSES. ` 12 13 WHEREAS, Ordinance No. 20,696 was passed on February 19, 2013, establishing a PZD,1. lan 14 Zoning District titled Interstate 430 Shoppers Mall Long-Form PCD(Z-3371-TT),located at 11940;04if ,� 15 Glenn Road; and %; r •°j cQUN s/ � 16 WHEREAS,the automobile sales and automobile collision repair approved for Interstate 430 Shopji''rsi ii i ill"'` 17 Mall Long-Form PCD (Z-3371-TT), located at 11900 Colonel Glenn Road, is no longer a viable project 18 since Baptist School of Nursing elected to maintain this location as their school campus and the owner of 19 the subject property has requested the repeal of the PZD ordinance and restoration of the zoning 20 classification as previously existed; and 21 WHEREAS,the Baptist School of Nursing has modified their degree program and is now considered 22 a college or university which is not an allowable use within the underlying C-2, Shopping Center District, 23 zoning classification; and 24 WHEREAS, Baptist School of Nursing is requesting a rezoning of the property from C-2, Shopping 25 Center District,to C-3, General Commercial District;and 26 WHEREAS,the Little Rock Planning Commission reviewed the requests for revocation and rezoning 27 at their July 16,2015, public hearing and voted 11 ayes, 0 nays and 0 absent to forward the revocation and 28 rezoning requests to the Little Rock Board of Directors for final action. 29 NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 30 OF LITTLE ROCK,ARKANSAS. 31 SECTION 1. That Ordinance Number 20,696 is hereby repealed, removing from the official zoning 32 map the classification PCD. [Page 1 of 3] 1 SECTION 2. That the underlying C-2, Shopping Center District, zoning classification is restored to 2 the property described as: 3 Lot 1,Interstate 430 Shoppers Mall Addition,Little Rock,Arkansas,containing 12.91 4 acres AND Lands located in the southwest '/4 of Section 16, T-1-N, R-13-W, City of 5 Little Rock, Pulaski County, Arkansas more particularly described as follows: 6 Commencing at the southeast corner of the southwest 1/4 of the southeast '/4 of the 7 southwest '/4 of said Section 16, which is also the point of beginning; thence 8 N88°5'22"W,611.95 feet to a point which is also on the east right-of-way of Bowman 9 Road; thence continue along said right-of-way line N23°55'49"W,261.77 feet; thence 10 N88°18'38"W 724.42 feet; thence N01°31'11"W,238.39 feet to the point of beginning 11 containing 3.637 acres, more or less. 12 SECTION 3. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little 13 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects 14 necessary to affect and designate the change provided for in Sections 1 and 2 hereof. 15 SECTION 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, 31 or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 32 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 33 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 34 ordinance.
