14174 1 RESOLUTION NO. 14,174 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO APPLY 4 FOR A GRANT FROM THE ARKANSAS DEPARTMENT OF PARKS 5 AND TOURISM'S OUTDOOR RECREATION GRANTS PROGRAM TO 6 CONSTRUCT A PERMANENT RESTROOM FACILITY AT THE 7 LITTLE ROCK ZOO; AND FOR OTHER PURPOSES. 8 9 WHEREAS, the City of Little Rock held a public hearing on June 25, 2015, for the purpose of 10 gathering input with regard to support for applying to the Arkansas Department of Parks and Tourism's 11 Outdoor Recreation Grants Program to construct a permanent restroom facility at the Little Rock Zoo,and 12 the attendees were very supportive of the project; and, 13 WHEREAS, prior to the public hearing, four additional public meetings were held to gather input 14 from groups, including seniors, minorities, persons with disabilities and the Little Rock Zoo Board of 15 Governors; and, 16 WHEREAS, the project will include restroom facilities for both males, females an ADA compliant 17 family restroom, and shaded rest stations in the grand plaza; and, 18 WHEREAS, if the grant is awarded, the City will be required, via an easement, to permanently 19 maintain the restroom facility and if it is required to be moved to another location, the City will be 20 responsible for the cost of the relocation; and, 21 WHEREAS, the City of Little Rock understands that the State of Arkansas and the City will enter 22 into a binding agreement which obligates both parties to policies and procedures contained in the Land 23 and Water Conservation Fund Grants Manual including, but not limited to the following: the area defined 24 by the project boundary map, submitted in the application, must remain in outdoor recreation use in 25 perpetuity, regardless if the property is bought or developed with matching grant funds and; all present 26 and future overhead utility lines within the project boundary must be routed away or placed underground 27 and; the project area must remain open and available for use by the public at all reasonable times of the 28 day and year; but cannot be reserved, leased or assigned for exclusive use, and; the project area must be 29 kept clean, maintained, and operated in a safe and healthful manner; and, 30 WHEREAS, the City will provide One Hundred Ninety-Two Thousand, Five Hundred Dollars 31 ($192,500.00), as a dollar for dollar match for the grant, with funds from the 2016 Grants Match. 32 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 33 OF LITTLE ROCK,ARKANSAS: [Page 1 of 2] 1 Section 1. The Board of Directors hereby authorizes the City Manager to submit an application to the 2 Arkansas Department of Parks and Tourism's Outdoor Recreation Grants Program to construct a restroom 3 facility at the Little Rock Zoo and, if approved, to provide One Hundred Ninety-Two Thousand, Five 4 Hundred Dollars($192,500.00)as a match from the 2016 Grants Match. 5 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 6 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 7 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 8 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 9 resolution. 10 Section 3.Repealer.
