Recorded: 07/28/2015 12:02:19 PM Filed & `e Aa r �r Recorded in Official Records of Larry Crane. • _ PULASKI COUNTY CIRCUIT/COUNTY CLERK - - Fees $40.00 1 ��J' RESOLUTION NO. 13,994 d • 2 ss Q ''/J`'` C00Nrt,t$ 3 ''A'°i RES'OLUTION TO AUTHORIZE THE MAYOR TO EXECUTE A 4 QUITCLAIM DEED FROM ARCHER-DANIELS-MIDLAND COMPANY 5 ACCEPTING TITLE FOR THE CITY OF LITTLE ROCK, ARKANSAS, 6 TO CERTAIN LANDS SITUATED IN PULASKI COUNTY, ARKANSAS; 7 AND TO FURTHER AUTHORZE THE MAYOR TO EXECUTE A 8 QUITCLAIM DEED OF THE CITY'S INTEREST IN CERTAIN 9 PROPERTY SITUATED IN PULASKI COUNTY, ARKANSAS, TO 10 ARCHER-DANIELS-MIDLAND COMPANY; AND FOR OTHER 11 PURPOSES. 12 13 WHEREAS, as part of the 9th Street Extension Project. a portion of 9th Street at Bond Street and 14 eastward was inadvertently built on property owned by Archer-Daniels-Midland Company that had not 15 previously been acquired by the City of Little Rock,Arkansas;and 16 WHEREAS, Archer-Daniels-Midland Company has agreed to provide a quitclaim deed to the 17 property referred to above in exchange for a quitclaim deed from the City of Little Rock to certain other 18 property located in the same area in order to correct the error that occurred as described above;and 19 WHEREAS, the City's Public Works Department Staff has reviewed the proposed transaction and 20 finds it to be an appropriate procedure in order to correct the error that occurred during the extension 21 project. 22 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 23 OF LITTLE ROCK,ARKANSAS: 24 Section 1. The Board of Directors hereby authorizes the Mayor to execute a quitclaim deed received 25 from Archer-Daniels-Midland vesting title in the City of Little Rock to certain property described in the 26 deed,a copy of which is attached to this Resolution as Exhibit"A." 27 Section 2. The Board of Directors also hereby authorizes the Mayor to execute a quitclaim deed to 28 Archer-Daniels-Midland vesting title in the company of certain property described in the deed, a copy of 29 which is attached Exhibit"B." 30 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 31 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 32 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 33 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the [Page 1 of 2] 1 resolution. 2 Section 4. Repealer.
