PULASKI COUNTY CIRCUIT/COUNTY CLERK Fees $20.00 1 RESOLUTION NO. 14,135 2 3 A RESOLUTION TO AUTHORIZE THE MAYOR, CITY MANAGER 4 AND CITY CLERK TO EXECUTE THE APPROPRIATE DOCUMENTS 5 TO ACCEPT DONATION OF LAND NEAR FLETCHER PARK FOR THE 6 PURPOSE OF IMPROVING SITE CONFIGURATION FOR FUTURE 7 DEVELOPMENT AND PEDESTRIAN ACCESS TO THE PARK; AND 8 FOR OTHER PURPOSES. 9 10 WHEREAS, City Staff has worked with area Stephens Neighborhood Association which has 11 expressed a desire to expand the park's future development potential; and, 12 WHEREAS, the subject land donation is located at 915 Appianway Street and its acquisition will ``Nllll II 117,,,l 13 close the gap between existing land already owned by Parks; and, ,„.,` �E CIRcilo,• , 14 WHEREAS,the land comprises 4,000 square-feet and is owned by TBL Rentals,LLC; and 15WHEREAS,plans are underway for what is specifically desired by the neighborhood but aa` . (;: 16 of the land will not only enhance further park developments, but will also improve pedestrian ac-g;;. tF._�`" 17 the park;and, ,,9s�� `� 4 itr 18 WHEREAS, a title search and Phase I Environment Assessment were performed and these studi WUh'h"�P�,�`` 19 found no adverse impacts for the City of Little Rock; and, 20 WHEREAS,funds for due diligence and closing costs are available through Parks Operating Budget; 21 and, 22 WHEREAS, State Law requires that the City accept the property by a resolution adopted by the 23 Board of Directors; 24 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 25 OF LITTLE ROCK,ARKANSAS: 26 Section 1. The Board of Directors hereby accepts the proposed donation, subject to the appraisal, 27 environmental assessment and title search. 28 Section 2. The property shall be used for a public purpose, specifically for the purpose of improving 29 site configuration for future development and improving pedestrian access into the park. 30 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 31 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 32 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 33 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 34 resolution.
