3 A RESOLUTION TO AUTHORIZE THE MAYOR, CITY MANAGER
4 AND CITY CLERK TO EXECUTE THE APPROPRIATE DOCUMENTS
5 TO ACCEPT DONATION OF LAND ADJACENT TO ROCK CREEK;
6 AND FOR OTHER PURPOSES.

8 WHEREAS, City Staff has worked with Boyle Park area neighborhood associations who have
9 expressed a desire to improve trail access and to protect riparian habitat of Rock Creek; and,
10 WHEREAS, Renaissance Commercial Contractors, Inc., has offered to donate 0.9 acres which is
11 located at the north end of Boyle Park between Leander Drive and Rock Creek, in order to extend the
12 existing trail in Boyle Park northwards into Kanis Park and further north where possible, and southward
13 to The First Tee,Western Hills and Fourche Creek Parks; and,
14 WHEREAS, a title search and Phase I Environment Assessment were performed and these studies
15 found no adverse impacts for the City of Little Rock; and,
16 WHEREAS,funds for due diligence and closing costs are available through Parks Operating Budget;
17 and,
18 WHEREAS, State Law requires that the City accept the property by a resolution adopted by the
19 Board of Directors;
20 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
21 OF LITTLE ROCK,ARKANSAS:
22 Section 1. The Board of Directors hereby accepts the proposed donation, subject to the appraisal,
23 environmental assessment and title search.
24 Section 2. The property shall be used for a public purpose, specifically for the purpose of improving
25 site configuration for future trail development and protecting riparian habitat next to Rock Creek.
26 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
27 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
28 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
29 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
30 resolution.
31 Section 4. Repealer. All laws, ordinances,resolutions, or parts of the same that are inconsistent with
32 the provisions of this resolution are hereby repealed to the extent of such inconsistency.
