21039 1 ORDINANCE NO. 21,039 2 3 AN ORDINANCE TO DISPENSE WITH COMPETITIVE QUOTES DUE 4 TO AN EXCEPTIONAL SITUATION; TO AWARD AN AGREEMENT 5 FOR A COMMUNICATIONS CENTER AUDIT BY THE ASSOCIATION 6 OF PUBLIC SAFETY COMMUNICATIONS OFFICIALS, 7 INTERNATIONAL, IN THE AMOUNT OF TWENTY-TWO THOUSAND, 8 ONE HUNDRED DOLLARS22100.0 ; ($ 0), TO DECLARE AN 9 EMERGENCY; AND FOR OTHER PURPOSES. 10 11 WHEREAS,periodic review of the Communication Center's organizational structure, programs and 12 procedures is essential to efficient,professional operation of the Center as new technology develops and as 13 public needs change;and, 14 WHEREAS,an independent audit of the Little Rock Emergency Communications Center's operations 15 performed by a public safety communications expert would help to identify equipment,staffing and training 16 needs and to pinpoint any performance issues that need to be addressed;and, 17 WHEREAS,the emergency dispatch operational standards adopted by the City were developed by the 18 Association of Public-Safety Communications Officials, International (APCO), a public safety 19 communications standards developer accredited by the American National Standards Institute(ANSI);and, 20 WHEREAS, it would be impracticable and contrary to the public interest to hire any consultant other 21 than an APCO consultant to determine whether the APCO operational and training standards have been 22 met at the Little Rock Communications Center and, in light of that evaluation,to provide communications 23 managers with advice on any issues surrounding effective and efficient operations;and, 24 WHEREAS, the Little Rock Board of Directors feels that this is a unique situation which makes 25 competitive bidding impracticable and contrary to the best interest of the City. 26 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 27 OF LITTLE ROCK,ARKANSAS: 28 Section 1. The Cityis authorized Manager g ut onzed to enter into an agreement with the Association of 29 Public-Safety Communications Officials, International for a communications audit and associated 30 consulting services in the amount of Twenty-Two Thousand, One Hundred Dollars ($22,100.00) plus 31 applicable taxes. 32 Section 2. Because of the critical need to utilize the City's current public safety communications 33 standards as efficiently and effectively as possible by requesting that the developer of those standards 'Page I of2I 1 identify any procedural or technical shortfalls, the Board declares that it is impractical and unfeasible to 2 submit this matter to a competitive bid process,and,therefore,waives competitive bidding. 3 Section 3. Funds for this service are available in the Little Rock Police Department's Seized Asset 4 Forfeiture Funds. 5 Section 4. Severability. In the event any portion of this ordinance is declared or adjudged to be invalid 6 or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this 7 ordinance, which shall remain in full force and effect as if the portion so declared or adjudged invalid or 8 unconstitutional were not originally a part of this ordinance. 9 Section 5. Repealer. All ordinances and resolutions,and parts thereof,which are in conflict with any 10 provision of this ordinance are hereby repealed to the extent of such conflict. 11 Section 6. Emergency Clause.
