9 WHEREAS, the adjacent property owners propose to abandon the south 150 feet of the alley riglht-
10 of-way located within Block 30,Original City of Little Rock,Arkansas, said block being bounded by East
11 4th Street, East Capitol Avenue, Scott Street and Cumberland, pursuant to the City's general police power
12 authority under Ark. Code Ann. §14-54-104; and,
13 WHEREAS,the Board has determined all adjacent property owners have agreed to the abandonment
14 request, no other property owners are required to be notified of the request, and the Downtown and
15 MacArthur Park Neighborhood Associations were notified of the abandonment request; and,
16 WHEREAS, the alley right-of-way is currently part of a paved parking lot within the south half of
17 the block and after abandonment will continue to be used as paved parking, with the possibility of future
18 redevelopment; and,
19 WHEREAS,two of the utilities request to retain the area of abandonment as a utility easement,and a
20 drainage and utility easement will be maintained following abandonment; and,
21 WHEREAS, based on the fact that the alley right-of-way is within the Original City of Little Rock,
22 the City will retain ownership of the area after abandonment; and,
23 WHEREAS, abandoning these rights-of-way will have no adverse impact on the public welfare and
24 safety and the Little Rock Fire Department has reviewed and approved the abandonment request;
25 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
26 OF LITTLE ROCK,ARKANSAS:
27 Section 1. The Board of Directors hereby releases, vacates, and abandons the south 150 feet of the
28 alley right-of-way located within Block 30,Original City of Little Rock, being bounded by East 4th Street,
29 East Capitol Avenue, Scott Street and Cumberland.
30 Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
31 records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County,Arkansas.
32 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
33 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or

1 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
2 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
3 of the ordinance.
4 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are
5 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
