3 AN ORDINANCE ACCEPTING THE PORT HARBOR ANNEXATION (A-
4 325), ADDING CERTAIN LANDS TO THE CITY OF LITTLE ROCK,
5 ARKANSAS; AND CLASSIFYING SAID PROPERTY TO I-3, HEAVY
6 INDUSTRIAL, (Z-9009) AMENDING THE OFFICIAL ZONING MAP
7 FOR THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER
8 PURPOSES.

10 WHEREAS, a petition for voluntary annexation (the "Petition") was filed with the County Clerk of
11 Pulaski County, Arkansas, by the owner of hereinafter designated lands praying that said lands be
12 annexed to and made part of the City of Little Rock,Arkansas; and,
13 WHEREAS, on February 25, 2015, the County Court of Pulaski County, Arkansas found that the
14 Petition was signed by a majority of the total number of the real property owners of the area to be
15 annexed and by the owners of more than one-half of the acreage of said area; and,
16 WHEREAS, said lands are contiguous to and adjoining the present corporate limits of the City of
17 Little Rock; and,
18 WHEREAS,an accurate map of said lands has been filed with and made a part of said Petition; and,
19 WHEREAS,proper notice has been given for the time and in the manner prescribed by law; and,
20 WHEREAS, all things pertaining thereto have been done in the manner prescribed by law and that
21 said lands should be annexed to and made part of the City of Little Rock.
22 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
23 OF LITTLE ROCK,ARKANSAS:

31 a distance of 1,808.12 feet to a point on the old center line of Fourche Bayou; thence deflect
32 36°39 minutes right 2,356 feet to the ordinary high water line of the Arkansas River; thence
33 southeasterly along the said ordinary high water line of the Arkansas River to a Point of

1 Beginning,said Point being the intersection of the ordinary high water line and the west line
2 of the NW '/4, fractional Section 14; thence southerly along said west line of the NW 'A,
3 fractional Section 14,for a distance of 200 feet to a point; thence southeasterly along the arc
4 of a curve to the right having a radius of 6,403.14 feet to a point, said point being 3,800.09
5 feet east and 434.33 feet south of the northwest comer of fractional Section 23, Township
6 1 North, Range 11 West; thence northwesterly along the ordinary high water line of the
7 Arkansas River, said line being in two segments created by the construction of the Fred I.
8 Brown Industrial Harbor, to the Point of Beginning; and containing twenty-seven (27)

10 SECTION 2. That the zone classification of the following property be and is hereby I-3,Heavy
11 Commercial as indicated:
12 Z-9009: The following described area,all lying wholly within Pulaski County,Arkansas,to-
13 wit: Commencing at the southwest corner of the SE 1/4, fractional Section 15, Township 1
14 North,Range 11 West; thence northerly along the west line of said SE V4, fractional Section

27 SECTION 3. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little
28 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects
29 necessary to affect and designate the change provided for in Section 2 hereof.
30 SECTION 4. The City of Little Rock shall provide police and fire protection from the effective date
31 of the annexation.
32 SECTION 5. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase,
33 or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
34 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and

1 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
2 ordinance.
3 SECTION 6. Repealer. All ordinances or resolutions of the City in conflict herewith are hereby
4 repealed to the extent of such conflict.
