14070 1 RESOLUTION NO. 14,070 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER 4 INTO A CONTRACT WITH CLARK MACHINERY COMPANY, IN THE 5 TOTAL AMOUNT OF FOUR HUNDRED THIRTY-ONE THOUSAND, 6 SIX HUNDRED THIRTEEN DOLLARS ($431,613.00), FOR THE 7 PURCHASE OF ONE (1) TRACKHOE EXCAVATOR, FOR THE PUBLIC 8 WORKS DEPARTMENT, UTILIZING THE HOUSTON-GALVESTON 9 AREA COUNCIL (HGAC) COOPERATIVE PURCHASING 10 AGREEMENT; AND FOR OTHER PURPOSES. 11 12 WHEREAS, the Public Works Department is in need of a Trackhoe Excavator that will replace an 13 older unit with high maintenance expenses and excessive down time; and, 14 WHEREAS, by utilizing the Houston-Galveston Area Council (HGAG), the City Fleet Services can 15 purchase a Trackhoe Excavator from Clark Machinery Company for the amount of Four Hundred Thirty- 16 One Thousand, Six Hundred Thirteen Dollars($431,613.00); 17 NOW, THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 18 OF LITTLE ROCK,ARKANSAS: 19 Section 1. The Board of Directors hereby authorizes the City Manager to enter into a contract with 20 Clark Machinery Company for the purchase of one (1) Trackhoe Excavator for the Public Works 21 Department,which will replace an older unit with high maintenance expenses and excessive down time. 22 Section 2. Funds for this purchase, in the amount of Four Hundred Thirty-One Thousand, Six 23 Hundred Thirteen Dollars ($431,613.00), available by utilizing the Houston-Galveston Area Council 24 (HGAC) Cooperative Purchasing Agreement, are allocated in Solid Waste Collection Capital Assets — 25 Equipment& Machinery account. 26 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 27 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 28 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 29 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 30 resolution. 31 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent 32 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency. 33 ADOPTED: February 24,2015 [Page 1 of 21 1 ATTEST.
