3 AN ORDINANCE TO AMEND LITTLE ROCK,ARK., REV. CODE §34-42
4 (1988) TO ALLOW TAXI OPERATORS TO ADJUST RATES UPON
5 FORTY-EIGHT (48) HOURS NOTICE TO THE CITY MANAGER; TO
6 AMEND § 34-43 (b)(1)(A) (1988) TO DEAL WITH RATES AND
7 ADDITIONAL CHARGES BY TAXI OPERATORS; TO DECLARE AN
8 EMERGENCY; AND FOR OTHER PURPOSES.

10 WHEREAS, the City recently approved an ordinance that would allow Transportation Network
11 Companies to operate within the City; and,
12 WHEREAS, during the course of this discussion the City asked that the taxicab industry propose any
13 necessary changes in order to better compete for public transportation services; and,
14 WHEREAS, pursuant to that request a modification in the manner in which rates are set has been
15 requested;
16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK,ARKANSAS:
18 Section 1. Little Rock, Ark., Rev. Code. § 34-42 (1988) is hereby amended to read as follows:
19 (a) An operator of a for-hire vehicle other than a taxi or a vehicle driven pursuant
20 to the ordinances for Transportation Network Services shall not charge a fare
21 for operating a vehicle in the city except as provided for in this chapter.A holder
22 may propose a change in the rates of fare by filing the proposal with the
23 administrator for consideration by the Board of Directors.
24 (b) The Board of Directors shall hold a hearing to consider the proposed change in
25 rates of fare.After the hearing,the Board of Directors may approve,disapprove,
26 or modify the proposed change.
27 (c) The Board of Directors shall annual review the maximum ceiling rates as
28 provided for in this chapter to determine the appropriateness of each rate.
29 (1) For a taxi operator, a change in rates may occur after forty-eight (48) hours
30 notice to the City Manager and the administrator has been provided; and
31 (2) For a vehicle operated pursuant to the ordinances for a Transportation Network
32 Company,the rates will be determined in accordance with those ordinances.

1 Section 2. Little Rock, Ark., Rev. Code § 34-43 (b) (1)(a) (1988) is hereby amended to read as
2 follows:
3 A taxicab ceiling rate may be charged if posted in the individual taxicab.The ceiling
4 rate may be increased from the initial meter charge at increments established in
5 accordance with this Code.
6 Section 3.Severability. In the event any section, subsection, subdivision, paragraph, subparagraph,
7 item, sentence, clause, phrase or word of this ordinance is declared or adjudged to be invalid or
8 unconstitutional,such declaration or adjudication shall not affect the remaining provisions of this ordinance
9 which shall remain in full force and effect as if the portion so declared or adjudged invalid or
10 unconstitutional was not originally a part of this ordinance.
11 Section 4. Repealer. All ordinances and resolutions inconsistent with this ordinance are hereby
12 repealed to the extent of such inconsistency.
13 Section 4. Emergency Clause. It is essential to the public health, safety, and welfare, to assure that
14 all regulations for the operation of public transportation in effect at the same time do not create an unfair
15 competitive advantage for any one industry,and in light of the entry of Transportation Network Companies
16 into the market, it is vital that taxicab operators be permitted to establish competitive rates upon proper
17 notice to the City; an emergency is,therefore, declared to exist and this ordinance shall be in full force and
18 effect from and after the date of its passage.
