209581 ORDINANCE NO. 20,958 2 3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., ORDINANCE NO. 4 20,956 (NOVEMBER 18, 2014) TO CLARIFY THAT SUPRLUS LINES 5 INSURERS ARE CONSIDERED TO MEET THE INSURANCE 6 REQUIREMENT FOR A TRANSPORTATION NETWORK COMPANY; 7 TO CLARIFY THE INSURANCE REQUIREMENTS FOR A 8 TRANSPORTATION NETWORK COMPANY WHEN THE 9 APPLICATION FOR AN AUTOMOBILE TO BE AVAILABLE IS ON BUT 10 NO RIDE HAS BEEN ACCEPTED; TO DECLARE AN EMERGENCY; 11 AND FOR OTHER PURPOSES. 12 13 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 14 OF LITTLE ROCK, ARKANSAS: 15 Section 1. Little Rock, Ark., Rev. Code § 34-20 (a) (1988), as amended, on insurance requirements 16 is hereby amended to read as follows: 17 Section 1. Little Rock, Ark., Rev. Code § 34-20 (a) (1988), as amended, on insurance requirements is 18 hereby amended to read as follows: 19 (a) Insurance requirement. No person, firm or corporation authorized by a permit to this 20 chapter may operate a vehicle for the transportation of passengers within the City, without first 21 securing, and maintaining in force at all times, a commercial auto liability policy insurance policy 22 issued by a company licensed and regulated by the Arkansas Insurance Department or with a 23 surplus lines insurer on the Arkansas Insurance Department maintained list of eligible surplus lines 24 insurers covering each vehicle to be used for the transportation service and in the following 25 amounts: 26 (1) For taxicab franchises, livery vehicles, premium taxicabs, and 27 all executive sedans and antique vehicles: Two Hundred Fifty Thousand 28 Dollars ($250,000.00) for the injury or death of any one (1) person and 29 subject to that limit for each person; Five Hundred Thousand Dollars 30 ($500,000.00) total liability for any one (1) accident; and Two Hundred 31 Fifty Thousand Dollars ($250,000.00) for each accident regarding 32 damage to property, with a maximum of Fifty Thousand Dollars 33 ($50,000.00) deductible coverage per incident. Said insurance in effect IPage 1 of 31 1 shall be for demand -response service vehicles, not scheduled or routed 2 service vehicles, and any vehicle used by a Transportation Network 3 Company Driver. It is further provided that for the time period when 4 TNC drivers have logged on to the TNC digital network or software 5 application indicating they are available to receive ride requests until 6 such time as the TNC driver accepts such a request, the TNC driver must 7 be covered by insurance at least in the amount set forth in Arkansas Code 8 27-22-104. These requirements for coverage shall be satisfied by either 9 (A) insurance maintained by a TNC driver; (B) insurance maintained by 10 a TNC in the event the insurance maintained by the TNC driver does not 11 provide coverage, or the TNC driver does not otherwise maintain 12 insurance covering this time period; or (3) any combination of (A) and 13 (B). 14 Section 2. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph, 15 item, sentence, clause, phrase or word of this ordinance is declared or adjudged to be invalid or 16 unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this ordinance 17 which shall remain in full force and effect as if the portion so declared or adjudged invalid or 18 unconstitutional was not originally a part of this ordinance. 19 Section 3. Repealer. All ordinances and resolutions inconsistent with this ordinance are hereby 20 repealed to the extent of such inconsistency, including but not limited to Little Rock, Ark., Ordinance No. 21 20,956 (November 18, 2014). 22 Section 4. Emergency Clause. It is essential to the public health, safety, and welfare, to assure that 23 all regulations for the operation of public transportation are in effect at the same time; because the initial 24 ordinance on transportation network companies was passed prior to this amendment to address a technical 25 insurance issue, it is important to assure that this provision take effect on the same date as the general 26 ordinance on such services; an emergency is, therefore, declared to exist and this ordinance shall be in full 27 force and effect from the date that Little Rock, Ark., Ordinance No. 20,956 (November 19, 2014) is in full 28 force and effect. 29 PASSED: November 25, 2014 30 _ ES '.- APPROVED 31 32 33 Su n LaCi y Clerk Mark Stodola, Mayor 34 !Page 2 of 31 1 APPROVED AS TO LEGAL FORM: 2 3 14.014,/..f/J U 4 Thomas M.
