3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO SIGN A
4 CONTRACT WITH BURKHALTER TECHNOLOGIES, INC., IN THE
5 AMOUNT OF $304,538.40, FOR THE CONSTRUCTION OF CECIL
6 DRIVE DRAINAGE IMPROVEMENTS; AND FOR OTHER PURPOSES.

8 WHEREAS,Bids were solicited for Project 3-B-4D, Cecil Drive Drainage, Bid#14-166; and,
9 WHEREAS, Burkhalter Technologies, Inc., was the lowest responsive, responsible bid meeting
10 specifications;
11 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
12 OF LITTLE ROCK,ARKANSAS:
13 Section 1. The City Manager is hereby authorized to execute an agreement with Burkhalter
14 Technologies, Inc., for the construction of Cecil Drive Drainage Improvements in the amount of Three
15 Hundred Four Thousand, Five Hundred Thirty-Eight and 40/100 Dollars ($304,538.40), which is the base
16 bid price of Two Hundred Fifty-Three Thousand, Seven Hundred Eighty-Two Dollars ($253,782.00) plus
17 20%contingencies.
18 Section 2. The project is authorized by Resolution No. 13,688. Funding for this project is from the
19 2013 Capital Improvement Bonds for Streets and Drainage.
20 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
21 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
22 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
23 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
24 resolution.
25 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with
26 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
27 Section 5. This resolution will be in full force and effect from and after the date of its adoption.
