20942 1 ORDINANCE NO. 20,942 2 3 AN ORDINANCE TO REPEAL CHAPTER 36, ARTICLE V, DIVISION 13, 4 SECTION 36-434.16, KNOWN AS HILLCREST DESIGN OVERLAY 5 DISTRICT EXCEPTIONS SECTION (ORDINANCE # 20,223); AND FOR 6 OTHER PURPOSES; 7 8 WHEREAS,the Little Rock Planning and Development Department Staff has meet with the Hillcrest 9 Residents Association concerning the proposed changes to the Hillcrest Design Overlay District and has 10 reached a consensus on the changes; and, 11 WHEREAS, the Little Rock Planning Commission has reviewed the proposed changes to the 12 Hillcrest Design Overlay District and recommends it for adoption. 13 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 14 OF LITTLE ROCK: 15 Section 1.That Chapter 36, Article V, Division 13, Section 36-434.16 Exceptions, be repealed. 16 Section 2. That the following be adopted as Chapter 36, Article V, Division 13, Section 36-434.16 17 Exceptions. 18 Property, if for any reason, that cannot be developed without violating the standards 19 of the Hillcrest Design Overlay District shall be reviewed through the Planned 20 Zoning District (PZD) section of the Zoning Ordinance, with the intent to devise a 21 workable development plan which is consistent with the purpose and intent of the 22 overlay standards. All variances to the underlying zoning requirements shall be 23 reviewed as per Article II, Division 2 Board of Zoning Adjustment. 24 Section 3. That this ordinance shall take effect and be in full force from and after its passage and 25 approval. 26 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 27 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 28 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 29 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 30 ordinance. 31 Section 5. Repealer.
