13963 1 RESOLUTION 13,963 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER AND CITY 4 CLERK TO EXECUTE A THIRD LEASE AMENDMENT TO THE LEASE 5 BETWEEN THE CITY OF LITTLE ROCK AND THE BOARD OF 6 TRUSTEES OF THE UNIVERSITY OF ARKANSAS, ACTING FOR AND 7 IN BEHALF OF THE UNIVERSITY OF ARKANSAS FOR MEDICAL 8 SCIENCES COLLEGE OF MEDICINE — DEPARTMENT OF 9 PEDIATRICS, HEAD START PROGRAM, IN ORDER TO EXTEND THE 10 LEASE FOR A PERIOD COMMENCING ON OCTOBER 1, 2014, AND 11 CONTINUING THROUGH SEPTEMBER 30, 2016; AND FOR OTHER 12 PURPOSES. 13 14 WHEREAS, by a Lease Agreement dated February 11, 2009, and First Lease Amendment dated 15 September 3, 2010, and Second Lease Amendment dated July 26, 2012, the City leased to the Board of 16 Trustees of the University of Arkansas, Acting for and in behalf of the University of Arkansas for 17 Medical Sciences College of Medicine — Department of Pediatrics, Head Start Program, approximately 18 5,427 square-feet of space to be used for a day care and related activities in Rooms 21, 28, 47, 52, 53, 54, 19 55, Administration Room and the Food Pantry adjacent to Room 39 at the Nathaniel W. Hill Complex 1 20 located at 2500 East 6th Street; and, 21 WHEREAS,this Lease will expire on September 30,2014; and, 22 WHEREAS, the parties desire an extension of the term of the Lease for a period commencing on 23 October 1, 2014, and continuing through September 30, 2016, upon the same terms and conditions as the 24 original Lease Agreement and subsequent amendments. 25 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 26 OF LITTLE ROCK.ARKANSAS: 27 Section 1. The Board of Directors hereby authorizes the City Manager and City Clerk to execute the 28 Third Lease Amendment to the Lease Agreement dated February 11, 2009, between the City and the 29 Board of Trustees of the University of Arkansas, Acting for and in behalf of the University of Arkansas 30 for Medical Sciences College of Medicine — Department of Pediatrics, Head Start Program, in order to 31 extend the term of the Lease for a period commencing on October 1, 2014, and continuing through 32 September 30,2016, upon the same terms and conditions as the original Lease Agreement and subsequent 33 amendments. In the event any title, section, paragraph, item, sentence, clause, phrase, or 2 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 3 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 4 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 5 resolution. 6 Section 3. Repealer.
