4 NEIGHBORHOOD ASSOCIATION BY QUITCLAIM DEED FOR USE AS
5 A COMMUNITY GARDEN; TO BE USED FOR NEIGHBORHOOD ff'
6 REVITALIZATION; AND FOR OTHER PURPOSES.

WHEREAS, the Board of Directors has stated as one of its goals a desire to proaltier.

9 neighborhood revitalization, and has taken special efforts to accomplish this goal through its 6s y A. �,.•-
10 various City and Federal Funds, and in affirmative actions such as the creation of a Land Bank
11 Commission; and,
12 WHEREAS, in order to accomplish this goal the City has acquired numerous properties in areas that
13 are appropriate for revitalization; and,
14 WHEREAS, in an effort to maximize its revitalization efforts, the City wishes to convey
15 underutilized parcels to community organizations for development; and,
16 WHEREAS, on January 14, 1997, the City acquired the property located at 4301 West 10th Street,
17 Little Rock, Arkansas, by donation; and,
18 WHEREAS,the parcel is a 5,382 square-foot vacant lot with no structure; and,
19 WHEREAS, the Forest Hills Neighborhood Association has indicated a desire to use the property for
20 a community garden; and,
21 WHEREAS, the City wishes to transfer the property located at 4301 West 10th Street to the Forest
22 Hills Neighborhood Association by quitclaim deed for use in its neighborhood revitalization efforts; and,
23 WHEREAS, State Law requires that the City convey property by resolution adopted by the Board of
24 Directors;
25 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
26 OF LITTLE ROCK,ARKANSAS:
27 Section 1.The Board of Directors hereby adopts this resolution to authorize the City to transfer to the
28 Forest Hills Neighborhood Association by quitclaim deed the property located at 4301 West 10th Street
29 for use as a community garden.
30 Section 2. The property shall be used for a public purpose, specifically for neighborhood
31 revitalization.
32 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
33 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or

1 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
2 effect a if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
3 ordinance.
4 Section 4.Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with
5 the provisions of this resolution are hereby repealed to the extent of such inconsistency.
